My Guess is , It is a rumour . since the USCIS suspended the I -140 Premium Service for the month of july . It clearly indicates they are aware/expecting many of the I -485 filings from July 1st and do not want to promise I- 140 decision in 15 days during July .
Yes, I am of the same opinion. USCIS wants to stop the premium processing for I-140 only because it anticipates large volume for I-485. I don't see why it would stop the cash-cow (premium processing) and stop taking I-485s too!!!

Actually I want to know how we can check that our I-485 is associated with EB2 and not EB3. Is there a code for this on I-485 application?

The last updated on my and wife's files were on 05/12/2009 (after the RFE Respnose)
I Went to the Local USCIS center on 08/02/2010. IO mentioned that Name check and FBI check had cleared. But he could not tell if my case was assigned to an IO. He asked me to open an SR. I called the 1-800 number and opened an SR on 08/03/10. I got a standard email from USCIS for the SR I opened, on 08/11/2010. It said that my case and my wife's were both were under review and it would take up to 60 days for them to process it.
On 08/13/2010 8.03 CST, I got a SMS on my cell that My case status was updated. I had received that Card Production was ordered on 08/12/2010.
Now, I am waiting on my wife's approval.

My lawyer also uses fedex, I dont think fedex delivers on saturday so I guess I am fine , right ? (Unless fedex guy goes out of his way and delivers on saturday to improve his performance!!)
Yes you are fine as long as he does not choose saturday delivery, which is very highly unlikely, and I guess he might be aware that the application should reach only on or after 1st july.

My new theory is the DOS was influenced by politicians who are attorneys (I beleive that there 50% of lawmakers) and it released a huge Visa Numbers. The politicians have strong connections to law firms. The USCIS doesn't want to do it, because it doesn't have 'resources', 'money', 'manpower. So, they are on a near strike mode, not attending routine works like sending receipts., etc in a timely fashion.

Many issues are being swept under the carpet. I had written a few times earlier. The backlog and GC issues are not truly a numbers game. It is the neo-con regime and the republican culture that had engulfed Washington, its consequences, that had made things miserable for us; we, the legal immigrants.
4/5ths of the illegal immigrants have been here by the time of Clinton's second term. It was a non-issue then. You should understand why is it an issue now? Why can't it the legal and illegal immigration be addressed and solved. In a democracy, things like this can be solved administratively, legislatively and judicially. Adminstratively, we we hit below the belt, in backlogs, in delays, in sudden rule changes (no concurrent filings of PD is not current). Legislatively, they are stalling and falling apart. What is left for the immigrants?

Why should you know? Why should you understand? It is in your own interests that you understand things wisely. Failure to know what is happening on the ground, what is happening around us is a sure shot for personal failure.

Thanks for your response. I agree with your point that "what uscis wants" prevails. I was trying to see if its possible to make sure EAD & AP are based on 485 with an approved underlying 140. I am not trying to get "multiple EAD/AP". Only trying to renew at the expiration of current once and trying to see if that can be based on new 485. My A# is same for both 485's
My questions again:
1. When I renew EAD/AP should I check that its renewal or initial application option.
2. How can I make sure (atleast try) the new EAD/AP will not be tied to old 485 but the new one (will send the new 485 receipt & 140 approval notice).

You are correct I missed that it can act as a very good buffer if I go by my extrapolated inventory which also factors in PWMB and if the May VB news actually materializes then yes Jul - Aug 2007 will be very easily crossed.

See, that's the reason I think the lawsuit idea has issues. I suspect the lawsuit may end up making life difficult for a lot of genuine cases without actually achieving what you set out to achieve.
But I have no data one way or the other.
The question is how would you identify which jobs are genuine and which are not. In addition, the question the porting comes at I-485 stage.
So in other words there could very well be job out there and you won't know till its I-140 is approved if it is for porting reasons.
Also, a good/established company may most likely will not file a new labor and I-140 for a person because it an unncessary expenditure for them.
So guess who are the people who are most benefitted by this...

I do not want to scare you but what you are claiming here i.e. while working on EB3-EAD aceepting promotion for a EB2-level skill can not be accepted by USCIS. You simply can not accept higher skill level based promotion like that. I think you should first sit down with a good lawyer and find out the solution of this already created mess and then think about interfiling.
Based on all info you provided it looks like our cases are not similar. I have already new approved I-140 - EB2 base - approved in year 2006. My 485 is attached to EB3.

Congratulations on getting approved. My wife traveleved to India in a similar situation. She left 2 days after the GC approval email. She returned yesterday on her H1B. I think the systems at the POE take time to reflect the new status. She was planning to inform the IO in case he/she asks about the GC approval - but they did not ask anything. Before she left, she spoke to a second level IO who said it was OK to travel and just to explain to the IO at POE in case it comes up. D-155 stamp is not done at POE.
Your wife can either use AP or H4.

Yes, I agree that not filing GC earlier is not an excuse for MBA. The point is he still would have been in the same situation (EB3, 2003 is not too different from EB2, 2005) in terms of how fast he will get his GC.
The law would allow him to port his EB3 PD just like how it is doing now. he will not be in the same situation, isn't this better now?

Yeah, am using a cordless phone. I dont remember but even with corded phone I guess I had this issue. And the cordless phone is DECT 6 phone which shouldn't interfere with the wireless connection that is at a different frequency.
And what alternatives do you feel could solve this problem?

Can someone explain why it seems harder to find backers in the house than in the senate for immigration reform (even the employment based legal immigration)? If we understand this, maybe it will help us focus our lobbying efforts better. Just a thought.

The constituency of a Senator is the entire state while that of a House Rep is usually much, much smaller. So the Senator needs to make sure that all his actions are more 'Inclusive' and do not offend a lot of people.
But since the House Rep has much fewer and probably much more homogeneous set of people, the needs of his/her constituents are not that diverse and hence they can afford to take a hardline stance in many cases.

This man is honest, candid and outspoken and unpopular:( at home(arizona) because of that. But the keyword here is candid and well-informed:). If the EB retrogression is presented properly to him, he could be an effective voice in the house.
Now, does anyone live in Arizona's 8th congressional district who can do something here. Arizona's 8th is most of Tucson, eastern Pima County, all of Cochise County and parts of Pinal and Santa Cruz Counties.
