I have an approved 140 and i am not considering pursuing a full time college program.
Can i apply to full time program and if i am admitted, can i apply for change fo status to F1?
Is this switch possible?

Guys,
My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.
I just don't want to loose my H1 status in any case.
I-9 should be filled by every employee, irrespective of your visa status; Go through the list A, B and C documents, it is self explanatory. This is the proof that you reported to work.

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

My OPT ends dec 08 and my H1 got selected in lottery but received RFE in Oct and case is still pending. Can I go for OPT extension right now as there is just 1 month time to file it?? Or should I go for premium processing of H1 and then go for OPT extension filing depending on H1 case result??
If I go for OPT extension right now even when H1 case is pending,
1)What happens to that OPT extension case if H1 gets approved?
2)What happens to that OPT extension case if H1 gets rejected?

I am on my 7th year H1B, valid until next year.
My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

Can some one file for H1 transfer when his/her H1 extension is pending?
Also there is a RFE on H1 extension which the company is responding.
Original H1 expired 2 months back but have a valid I-94 till december.

I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.
