This is my view about how USCIS has messed up in name check delays.
Name check PROGRAM that they might be using takes into account phoenetic spelling of FIRST and LAST NAME. Now just imagine, if your name is broken into 100 different spelling combinations and when your entire BIRTH YEAR IS checked against the databse--it will be surprising if there are no HITS. And to resolve those hits, pre-1995 records needs to be serached manually. There is no responsibility or time commitment by FBI or USCIS for the delay.
This might be true for Asian names. The argument is-- the names in the databse are translations and therefore, they need to check accordingly.
I BET they are not doing this for AMERICAN names, I mean for passport approval, they do not apply phoenetic program. I remember that FBI testimony included the discussion that they have set up appropriate filters for passport applicants (american citizens) so that unnecessary hits are avoided. Now this is my view and a discussion point. I may be wrong too.
In effect, Indian and Chinese professionals are deprived of immigration benefits.
Equally controversial is per country limitations in EB categories. If you do not select based on country of origin, you should not be subjected to per country limits because you are working for an american company and you are going to be american. Any demographic adjustment need to be made in diversity visa lottery.
This retrogression in effect deprives Indian and Chinese professionals of their benefits.
Justice and fairness has it that these problems need to be addressed. Abundant common sense and deeply practical approach that USA has, I am sure above problems will find attention. This great nation has always supported JUST and FAIR rules.

WiFi is 2.4 GHZ.
5.8 GHZ phone will have many disadvantages.
The BEST choice for cordless phone for range, and lack of interfearance is a DECT phone.. the 1.9Ghz range is a licenced radio frequency for the exclusive use of cordless phones, unlike any other cordless phone frequency (900Mhz, 2.4Ghz, 5.8Ghz.) and as it is lower in frequency (aside from 900 Mhz) it operates with the furthest distance than any cordless phone.

People are counting quota , no of visa available etc.. H1b denied.. Fight for Eb2 vs Eb3 , interfilling. and we have what less than 24 hour for our fate.

I am thinking that we should do something like have IV attorneys look into this PIMS delas and we should may be do another letter campain? (strictly speaking, I know this cannot become an agenda item for IV).
If this trend with PIMS continues (which is what it looks like), sooner or later it may affect a lot of people on H1b month after month who are going for visa stamping. With priority dates retrogressed badly this will become another pain point.
Who in IV do we have to run this by?

The law unambiguously states that for employment based categories - EB1 spillover should first go to EB2 and whatever is not required by both EB1 and EB2 will spillover to EB3. If the USCIS has been doing something different previously they were actually not following the letter of the law.
Here are the relevant sections of the INA which unambiguosly states the above.
Here is what Section 203 of the Immigration and Nationality Act states -
EB1 -
(1) Priority workers. - Visas shall first be made available in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (4) and (5),...............
EB2 -
(2) Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability. -
(A) In general. - Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1) ...............
EB3 -
(3) Skilled workers, professionals, and other workers.-

Yes, the same law can be interpreted like this:
EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW

But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?
So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.
So where is the correct interpretation? Does any body know?

Two weeks is substantial considering that in May EB2I movement is supposed to 0 days. :)
On a more serious note, Shusterman had to adjust the statement because everyone is going to question their credibility when the VB comes out and if it is only 2 weeks and not the 'years' that they claimed. Shusterman is just another person who spoke too much too early.

I believe it is horizontal spillover and not vertical spillover. I think it makes a huge difference for EB-2 on how the spillover is calculated.
Its a great start to analyze with some numbers rather than the predictions based on wish.

Companies can and will have internal documentation standards regarding employibility.
In fact lately, judges have even upheld firings of smokers from certain companies.
IF there is a pattern of discrimination based on age, sex, national origin etc etc. THEN you can sue.. but NOT just because you don't like the policy of the employers..
People don't realize it but US laws actually give plenty of leeway to employers related to that.. only relevent law applying here would be "EEO" and that doesn't mention anything related to EAD.
Legally you don't have a leg to stand on.. but you can try.. tell the lawyer , they have chance to set precedent!

You have read and find out. When you file for AOS, you will do one set for Principal (search and read elsewhere on IV) and one set for dependent (search and read elsewhere at IV for a complete set of docs).
So, you need to file one set of the latter. I don't know why you say add to mother's file. Is mother principal applicant or you.
These are based on common sense and logic. Read and verify.
If possible get (search and get AILA Handbook on AOS, I read somewhere there is one)

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. If they were submitted on 8/30/ and it's not cleared yet and your derivatives are cleared then more than likely you are stucked, there is some probability that you might be cleared in few weeks depending on number of hits generated against your name and avaialibility of the documents needed to be refered by fbi to clear you. However you dont need to worry much because now a days fbi seems to getting work lot faster then it used to. Also since july fbi has increased the fees that they charge USCIS to do the check which has increased the staff at NNCP and so the efficiency. I would suggest for you to wait 60 days and try again. Hopefully you have good news. I have been waiting 35 months.

Do you what you are talking about? One more term for GOP is a disaster. McCain would do nothing but spending more money on Iraq. There is no policy for John McCain. His only aim to continue Iraq war for 4 more years, and if possible, another four more years. They DON'T support same sex marriages. Remember! they are conservatives for God's sake. 3. Envelope provided by the consulate (yellow, blue or green color)

Good luck to all those who are still awaiting confirmation. There is no use calling the VFS people, as they have no information. But it helps to know from other candidates on the time frame. So other people who have got the email, please post your experiences here for the benefit of all.

How about we create a video. Take parts of this (http://www.comedycentral.com/motherload/?lnk=v&ml_video=89349) from the daily show. Take parts from the 60 minutes and read out from the NY Times article etc.
Then post it as a reply to every Lou Dobbs video posted on you-tube.
