I would appreciate some feedback on following situation;
1) My wife is on H4/EAD. She is beneficiary of my AOS application. She holds Master's Degree from US. What is the best option for her to work on?
2) She was on H1B from Oct 2001 to Mar 2003. She COS to H4 after her job terminated with-in weeks. Since then she's been in US (on H4) and never been out for more than couple of months. Can she apply for H1B and not limited to H1B quota and wait till Oct?
3) Would changing to H1B abondon her AOS?
4) Can she work on EAD now and switch to H1B around Oct time if she has to apply for fresh H1B for next yr quota.
4) If she can get H1B, can she still use AP for travel?
6) If i loose job or my 485 is denied, isn't it better she has H1B so i can get on H4 or on her GC application.

My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

A reader sent me a link to a post at the The Future of Capitalism blog reminding folks that being pro-immigration fits right in to a conservative agenda: David Cameron, the British "Conservative" Party leader who favors a top income tax rate of 50%, also wants immigration restrictions that would limit Great Britain's population over the next 20 years to 70 million. Hey everybody, My friend have a situation. He is from Haiti and he been in the USA since 1998 on a visitors visa but stayed. Graduated school, but couldn't do nothing else because of his papers, he lived with his sisters and they didn't work on it. Had a little situation in 2007 where he left the scene of an accident because he didn't have papers. They called it a felony, and now the (TPS) came around and he got denied because of that felony. He doesn't know where or what to do, don't have money for lawyers because he cant work. Anybody out there been there that knows what to do please feel free to do so. GOD bless

Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.

While filling my biographical information form (I-325a) I forgot to add one of my residential address which was in a different city where I stayed only for 2 months. I was wondering will that be a major issue?
I remember this is the address I gave when I got a job and they did a background check on me. If there are any repercussions how do I rectify the solution, can some one please respond?

I am currently working on L1b and I want to swicth to H1b so I just wanted to ask if i file a fresh H1b or trasnfer my existing L1b to H1b ,will I be able to work right away without any hiccups ?

This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.�
I'm no more working for this employer and I�ve changed to a new employer a year ago. What does this status mean?Any ideas?
Does this cause any problem to my current GC process which was sponsored by current employer?

I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

JUST before Congress adjourned for its August recess, Democrats engaged in a flurry of legislative activity, while Republicans complained about a �do-nothing� Congress�s meager policy accomplishments. Deep partisan differences, narrow majorities and a Republican in the White House have frustrated Democratic ambitions and fueled a toxic atmosphere in both chambers of Congress. The public�s low approval ratings reflect broad discontent with the direction of the country but also displeasure with Congress for failing to reverse course on Iraq and for continuing the bitter partisan warfare.
But has this really been a do-nothing Congress? The circumstances are similar to those in 1995, when a new Republican majority in both houses took office under a Democratic president. So perhaps the best question to ask is, how is this 110th Congress doing compared with the 104th Congress, in 1995?
Both new majorities began by spending more time in session, holding more committee meetings and roll call votes, and passing more substantive measures than the Congress before them had. At the same time, in both cases, the number of bills signed into law by the president from January to August dropped.
Still, the Democratic Congress�s legislative harvest this year has been bountiful compared with that of its Republican counterpart in 1995. Back then, the Republicans� Contract With America was stymied by opposition from the Senate and the president. The new Congress has enacted a far-reaching lobbying and ethics reform bill, an increase in the minimum wage, recommendations of the 9/11 Commission, foreign investment rules and a competitiveness package, and has embedded a number of major initiatives and new priorities in continuing and supplemental spending bills. Democrats also made headway on energy, children�s health insurance, college student loans, Head Start, drug safety and a farm bill � though much of this awaits action in the Senate or in conference and faces a possible veto.
During the first seven months of 1995, Congressional oversight of the executive branch increased modestly in the Senate but not at all in the House. But this year Congress, especially the House, has intensified its oversight, following years of inattention and deference by its Republican predecessor.
Democratic promises to restore civility and regular parliamentary procedure by allowing the minority party a larger role in deliberations have foundered. The number of restrictive rules for debate has increased, and the conference process has been short-circuited on various occasions.
In the Senate, Republicans have made the filibuster, or the threat of filibuster, routine, setting a 60-vote hurdle for all contested legislative matters. This has led Harry Reid of Nevada, the majority leader, to file many more petitions for cloture than Bob Dole, his counterpart in 1995, did.
The chart below shows what the 110th Congress accomplished before it closed for its August recess, compared with its immediate predecessor and with the Republican Congress that took office in 1995.

Currently, I am working with software firm (not a contract work). My wife is re applying for H4 visa. she applied for h4 last year in Feb, i used to work with contracting firm then and refused under 214b(immigration intent). This time we are applying through attorney. Attorney have sent email thrice to Islamabad consulatein Pakistan stating that denial under 214(b) for H4 is not valid reason.
But no response from them.
However my wife is applying again and taking letter with her from attorney stating that reason was invliad.
I am wondering
1- Do we need to highlight the previous denial so much as she is applying on new h1B now
2- in any case, can they revoke and cancel my petition as if they do not find any valid reason to reject again.
I am looking forward to hear from you
