To add to this point. This is AFTER the implosion of CIR on the Senate floor. CIR was supposed to be the reason issues around legal highly skilled immigration were deferred.
So, after deferral, implosion of CIR, we yet get a line clumping these two. It is almost like a nicotine addict trying to break the habit. Media can be so close minded.
All I can say is what IV has done to try to separate these two issues, is nothing short of herculean. Now atleast we are seeing some semblance of a separation. I think the Rally in DC was a highly significant moment in this regard. I am also pleasantly surprised to see as much attention given to the immigrant visa issue (ie green cards) as was to the rest of it. Previously highly skilled immigration was thought to be tantamount to H1b visas. The issue of permanent green cards was a footnote.
We have tried very hard to separate ourselves and not be a hostage of other issues. Now there is more awareness on the greencard issue being separate from H1B. There is also more awareness that Immigration problem is not just about Illegals. There are legal immigrants too in this country suffering.
Pls post letters to the editor. Last week we are able to get CNN correct their incorrect reporting of the rally due to effort from everyone on the forum.

nevermind....i am preaching to the choir. And why do you think the White House was in touch with Immigration voice leaders and not with some corporate lawyers during the July 2nd fiasco if they did not recognize the strength and commitment of the skilled immigrant community and btw what makes you say 'july 2nd will never happen again.' what are you? God?

I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.
Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(
I think if all the above issues are solved/cleared, probably a point system is good for us (i.e., EB based immigrants who are now stuck due to backlogs and retrogression). :p
Once you have a point system , a whole lot of people will be qualified, many more than currently on H1B from other countries , it will again clog the system, remember for canada the waiting time in india is 5 years now for skilled people who have enough points.
Again it goes to the basics how many skilled ot semi-skilled people they want in this country.
thanks

I'd say, we've waited enough(6-12 years). I know we are all chasing the american dream (perhaps it is just a dream), we should just make peace and move back. Thank you congress, america for giving ppl (from so called 3rd world nations) like us the chance to come and serve this great nation.
mind you.. dont forget to take back your $$$
The idea is excellent. You go ahead. I'll follow you shortly afterwards.

I would not worry much about whether we receive our package back or not. Because If USCIS is "rejecting" then how would you/your lawyer know that it has "rejected" it unless it sends the crap back. So legally USCIS HAS to return /mail back to you otherwise it will face another lawsuite. The real question is How it will reject it? Would it open a package and check for insufficient/improper documents and put a note about it and then reject it OR just put a note of rejection on closed envelope and returned back without opening it? In second case we are absolutely fine as far as second time filing is concerned but guys in first scenario if you really send insufficient documents/improper documents then your case may be screwed permanently for second time filing. Actually people MUST ask about this to their lawyers before jumping into the bandwagon. I have asked and waiting for my lawyer's response.

From past couple hearings it seems like not EST but UGST (US Govt Std. Time ).. Eureka... I just discovered new time zone. I am working on to get patent on it.. Please dont run to Patent office.

What are the implications for software industries - if dollar goes down againest rupee?
a. Lesser profit margins for Indian companies which might result in cost cuts and layoffs;
b. Lesser salary for Indian software employees in India;
c. BSE will crash down to adjust to the currency changes;
d. Indian real estate market will go down as the NRIs will not be able to afford land prices;
e. Indian farmers will be effected because imported agricultural products and food grains will be cheaper;
f. American companies will not be able to afford outsourcing in India and will be forced to bring more H1b employees from India to develop inhouse;

Please feel free to comment or correct any facts.
Fact Sheet: Who's Looking Out for You?
Green Card Visa Numbers Situation
 The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
 Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
 Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
 It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.
 Employment Based Immigration reforms do not find enough support on the senate floors (Failure of SKIL, STEM etc Bills). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting on the bills.
 USCIS is a self-funded organization i.e. it is run on fees it receives and is short on resources.
What do these jargons mean?
 Priority dates will remain retrogressed for several years.
 Those who could not file their I-485 now will now have to waitttttt..
 Due to resource constraints, security checks may take years.
 Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
 Endless cycle of EAD renewals and Advance paroles.
 For any reason, if any of your EAD gets rejected, you will need to stop working, In other words, need to leave your job.
 You need to be in the same position with same job responsibilities for an indefinite time period otherwise you Green Card application will be rejected.
 EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.
 Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
 So virtually you have three options: a) Struggle for several years b) Leave the USA c) Join us.

maybe we need to have a counter on the main page...
which shows member strength..
don't worry, the republican minority in the house has no power whatsoever. A simple majority is what it takes to pass a bill in the house and the Dems have more than a simple majority (50% + 1).
Only the senators can call for a fillibuster.

Are you sure that you would get back what ever you paid for the policy?. LIC in India is different story than western insurance companies.No Ins. company gives back what you paid on whole life, Please make sure how much you get back when policy matures.
Give me your insurance company/policy name ,I will tell you how much you are loosing on whole....?
thx

there is no rule defining any length of period that you are required to stay with Gc employer but most people recommend 6 months mainly because of possible questions at citizenship interview.
If you have a very good reason to change jobs sooner than that then document it and be prepared to defend your actions if you plan to apply for citizenship.
I dont see any reason why this would affect spouse.

How about we will bet for/against predictions and let all the proceedings go to IV???
IMO... MOST (Yes, I meant MOST not ALL) of the folks who play prediction game are freeloaders. Once money is involved they will disappear.

Should we write letters individually stating how this law has been unfair to us personally? I do not think DOJ will respond to each of us individually. This has to be a mass campaign under one umbrella to be effective. I understand that the leaders in IV are pursuing this with congress currently so probably cannot participate in this campaign? What other ways do we have? Could this be an online campaign?
On a separate note, it has been frustrating to see politics in US congress over last two years. I am sure they know about the legal immigrant issues and about retrogression, but clearly say no piecemeal legislation would be passed. They work purely for vote bank which we are not. I would favor working on alteranative means to try to get relief.

This confirms unless we get major reform for addressing backlog, all this idea of making 485 current is eyewash and nothing but trap for exorting money out of legal immigrants every year to pay for USCIS funding.
