It cannot be people vs terriblething. It could be state/federal agency v. terriblething. I agree that credibility of the complaint can be easily attacked if wife gives contradicting statement.

I-140 - Not filed yet
I am about to file I-140 (PP) and I-485 concurrently beginning of June.
But looks like the the May 21st cut-off screws it up completely.
I have heard someone say that I might escape the new law if I get a Green Card before the law is enenforced on (10/1/2008). Does this assumption even hold any ground? Doesn't the proposed bill say that anyone who has filed I-140 after May 21st 2007 has to reapply regardless of where he is in the process.
Gurus please advice.

Even in that case, all the benefits they were hoping to get from increased fees will be lost - and much more than that.
Average fee hike is $500 but average reimbursement of expenses would be atleast $1000
As per various lawyers' web-sites -- It is highly unlikely that there will be reimbursement of expenses even if case is won.

I tried without success to get a life insurance here in the US, the reason: no GC. You can get life insurance but the premiums are outrageous.
Agent from New yourk Life told me that other comanies are not familiar with non-GC (such as US on H-1B candidates) so they are not ready to go for h-1B life insurance, but since New yourk life is Already in market for other ethanic communities that understand other immigration issues and ready to go for Non-GC candiadates too.
so my question is have you approached them during your efforts, what were your conclusions if you approached them.

How are you trying to locate your record? Do you have your case number handy? Employer details, priority date - all that helped me find mine (rather helped me narrow it down).
I downloaded the 2004 file as you said and searched it, but could not find any information about my labor. Do you think the labor apps processed by backlog centers are in a separate file???

1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed
2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Which company should I say I am working for present or the future ? Also If I do take a leave of absence should I send in AC 21 paperwork or no?
PLEASE HELP I am very confused--- I strongly feel that the leave of absence might be an insurance policy but I don't know how to approach it !!

Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equivalent". that might be the caused the I140 denial .
Any one had this situation before ?

Why is llc less risk? i know that the legal paper trail requirements are lower... but i dont know of any other major benefit than ability to share profit and loss disproportionate to ownership stake... which could be a double edged sword too... what risk is covered in llc that is not covered in corp?
in fact i chose corp because it was cheaper.... thats it.
I started an LLC earlier this year. Much easier and less risk with an LLC. It is still early to say whether the company will make it to higher grounds or not. But I sure am trying. I have me and my wife as manager members. No employees at the moment.
Best of luck to you all. GC or no GC, we can still make the entrepreneur dream happen.
