Hi,
I have an approved I-140 (EB2 PD Jun-06) for a 'software engineering' related position. I recently moved to a 'product marketing' role within my company and was told that we would need to refile my PERM since this move constitutes a material change. Is this true?
1). Will I be able to retain my original PD of Jun-06 if we were to file for a 'marketing position'? Or would this be only possible if I needed to refile for a 'software engineering' or similar role?
2). Is there any way I can benefit from EB2 becoming current in July given that I have an approved engineering I-140 despite the fact that I have moved to marketing? (By the time I refile a new marketing PERM, I suspect retrogression will be back in effect)
3). My H1B was recently extended by 3 years (I complete 6 years in a few days) based on my 'engineering' approved I-140. They also filed an adjustment of my job duties to reflect my marketing role. I will visit Calgary, Canada next week (June) to renew my H1B stamp. By September 28 all the Visas are exhausted(2009 Quota). Please see the thread "September Visa Approvals". Infact some one was saying USCIS stopped issuing GC for the last week as they have used all visas. That may be the case they would have withdrawn approved GC
But try all the possibilities like SR, Infopass, Congressman, etc and let the local office be aware of Oct Visa bulletin and now are current and visas are available.

On Aug 17th the message changed to "On Aug 16th Card Production Ordered...."
when should I expect the card in mail?
For me and my family, it took exactly 11 days for the cards to arrive after the CPO mail.
6 days from CPO mail I got the Welcome Notice or Approval notice.

Also, another point to note is that government came out with this data at this moment, because this will instill a ray of hope in every EB individual on their future prospects due to reduced filing from Sept. 2008 onwards.
If, the government came out with the same data, one year back, we would be VERY depresssed, won't we?
So, there is a ray of light at the end of the tunnel.

We are only being shown data which shows pending applications from USCIS. If USCIS releases data of how much demand by priority date they were getting then its a different thing. LC substitution is not wrong if you look at what it was intended to do. Employment based greencard application is an employer's application and he has the right to give it to whomever he wants to.( especially when an employee leaves him)
The issue was that this provision was misused by many employers.

I just learnt from my lawyer that he submitted my I-485 aplication one day before my medical reports reached him. Basically he filed with out the medical reports. Will USCIS reject my aplication?He is saying it is allowed?
You should be fine, one of the latest FAQs says you can file without medical report.

Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

Having made a one time contribution was enough to get access to donor forum or so i thought. I really did not know that you need to have a recurring payment to get access to the donor forum.Most paid content websites may have that model but somehow I am uncomfortable with that idea here, and i am sure there are others who may feel the same.
Come up with a one time payment for one years access. It could be 300.00 USD to start with which is the same as 25.00 USD for 12 months which is the minimum you guys have set up. Many more will be comfortable with that.
Its just like rubbing me on the right side and you get my money ;), a trick which my wife exploits to the fullest :rolleyes:

Can you please provide me the sequence to call TSC using the POJ method? Based on what I read earlier in another thread, it was mentioned to choose option 4 which is to reports cases that were seperated. I tried that, reached an IO. IO told me that I should not be calling that number to check the status of my case. Do I need to choose another option?

Looks like they do not publish the e-mail address to contact congressman. You can send e-mail only through contact your rep system where you can send only to your local rep. If your ZIP code does not match the congressman's district, then you cannot send him the mail. Even to Judiciary committee chairman !!!!!!!!!!!
