If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

I think this has been discussed on some other thread.. would it be a good idea to make the contributions public.. may be, this encourages others to contribute, when they realize how much more is needed to reach the monetary goal.
I attended recent meeting arranged by IV in Virginia and they discussed about all this info you are asking. I don't think core team can publicly disclose all this info. I filed an apeal for my first PERM too and preparing to file another one (through another company - you can't file another PERM via the same company while your first PERM is in appeal). Your's is there for longer than mine. I heard 4 to 6 months would be the time. Please let us know when and how yours is resolved.
Styrum: Why did you file an appeal on your first perm and why are you planning to file another appeal? Maybe I am not understanding something here. was your first LC denied? (on what ground?) why your second LC denied?? Please explain. it seems that we are on the same boat but my appeal have been there longer (now over 6 months)

another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

One interesting point that came out of that recent hearing.
PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!

Can somebody clarify what it means that "salary is large enough" for EB2?
If a PWD was obtained from the state "workforce agency" and it has some number there, the job order has been placed with that number, can DOL and/or CIS later on (while processing PERM and/or I140) still say that the salary is "not good enough for EB2"? Based on which considerations and how are we and the employer supposed to know them beforehand then?

The idea has been floating around on the Internet for a couple of years now. No wonder, the nationalities set to benefit from this proposal (Baluchis, Pakhtuns, Kurds, Shia Arabs etc) are enthusiastically rooting for it, while the ruling elites of the so called artificial states like Pakistan and Sunni Iraqis are adamantly against it. Even I was thinking on the same lines and discussing with my friends. My son travel with us using PIO. But I was thinking to apply for the OCI.
Now the question is Pros and cons of OCI on PIO.
With OCI pro is
- one can live in India as long as he wants.
- Donot have to pay NRI fees in the school and colleges.
Cons -
Indian law will be applicable, means something happens US government won't do anything.
Rest of the NRI rules are applicable, no right to vote, limitation on kind of investments
Guys this is all I know, put more together so that everyone of us in the similar situation can make a decision.
Now the question is Pros and cons of OCI on PIO.

Yes I think we should also try to see if non-immigrant people who have already bought a home they should higher priority date than people buying now. Also given the case of ailing auto industry add buying American car in the list too.
