    I got a new job and joined on EAD. left 3 yr h1 validity for this job
    Current ead expires on sept 5 th, if i don't get renewal by then , i would lose my job as it's big company. I field on June 24th and receipt date is june 25th

    Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.

    Yup...according to my lawyer, hard copy is required. I had all my paperwork in by the 22nd..and the reason they did not file on Friday for Monday delivery was that there was no Labor copy. Luckily the labor arrived on Friday...but then my case got pushed behind others...

    Here is what i think ........USCIS works and approves according to RD till 140/485 approval. After this they hand over the case to DOS for visa issuance who work according to PD when allocating visa numbers. Correct me if i am wrong.

    This confirms unless we get major reform for addressing backlog, all this idea of making 485 current is eyewash and nothing but trap for exorting money out of legal immigrants every year to pay for USCIS funding.

    but saw 10 postings about IV in Indian (desi) sites., like www.kcdesi.com, one from Detroit, one on Sulekha and a few other Chinese sites. I guess these are blog posts. If it is useful, I will post each or all of these. Even, some Canadian sites have picked up issues listed in IV home page ( and probalbly spinning them to their advantage)
    Can we do something in Indian regional news papers? I know http://www.eenadu.net or http://www.vaarttha.com/ two most popular online Telugu newspaper for skilled immigrants in US. Also www.idlebrain.com has popular enough which might help different group of people to know about what IV is doing.

    I tried the following a couple of days ago.
    i got a letter from my company about my status and issue with retrogression, I took a printout of the webfax from the IV site and sent a certified mail to our state senators (i am from CA). I think this is better than a web fax, i am not sure if they even read the web fax. I havent received a response from them as yet, but i am sure i will. Others can try it too and see if they get a response.
    I did this because a senior manager from my company got fed up with his visa process and returned to Canada last month. He was ROW EB3 when he started his process.

    good response. we are all in this together and need to work together in order to get things done. IV is not just IV core but each and every member. each member should try to do something positive in order to help IV in whatever way theycan. - contributing money, help increase members, contact their local lawmakers and also contacting media. we need to raise awareness andevery small positive action done by an iv member helps in the overall scheme of things.

    My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.

    I sit next to am all American worker who has 30 years of experience, has 3 master's degrees and claims some major achievements in his technical life. Facts: I had to set his browser's proxy multiple times so that he could connect to the internet. He does not have 1% of the skills he claims and the word is out that he will be laid off next week. Although I am sure he has a membership of Programmer's Guild and IEEE and all that (he wears soda glasses , and it really makes him look brilliant). The point is , cases such as these make our presence here viable.
    I have more examples of such geniuses I have seen over past 10 years.
    It is not a secret that all of us are not innovators.However one must accept that there is a shortage of people who can run these operations.In my professional life , I have not seen a skilled American unemployed. Financial reasons may force a business to lay off a good worker. However, if you are good , you get a job instantly.
    I am lucky to be working at a place where your skills are more important than your nationality.

    There is something which is personal...buying a house is one such...opinion poll shouldn't decide that....GC or not if you feel like buy one...

    We went thru the same decision 3 years back but not buying a house was one of the best decisions....the best way is to ask people who are selling houses....in the northeast it is a hell to sell houses.

    My suggestion if you are a medico or a lawyer go ahead....but being attached to the tech sector is no safety net for buying a house....I have had friends with 300K take home file for bankruptcy in this economy after both members loose very lucrative jobs....just a statistic...by 2010 more than 50% households in the USA will owe more for mortgage than their houses net worth.....

    Again it is an individualistic decision....go ahead if you feel confident...two things you must make sure you are in the house for at least 3 years....tax savings are no security...house tax and work on the house do add costs up....

    + House in USA is no longer an equity proposition but a liability...

    I am surprised...why IV is not raising this.. The fundamental issues of EB immigration wont' be solved until CIR happens and that could take forever. No one cares about immigration right now.. The only thing that can provide immediate relief for EB immigrants is if we express our desire to buy houses(unable to do so becoz of lack of GC).

    There was a funding drive recently and also in the last quarter of 2008. Total contributions in the last 6 months have been too little to engage in a full fledged lobbying effort on any issue. Despite that we pushed through.

    Before we start blaming IV core, let us see if we are all ready to take part in IV action items. If people do not take part in any action item and support IV en masse then success will be hard to come by.

    7. I see a lot of nice quotes in some of the texts. Maybe it is nice to collect some of the nice quotes and publish them somewhere.

    Maybe its best to use our contacts in our home countries to get some stories printed in leading newspapers/publications. In this flat world, the stories would float around and reach a wider audience.

    Rough Estimate:
    500k EB applicants, 100K IV Visitors, 20K registered IV members, 1k one time contributors and less than 500 recurring contributors. Extending help to Core not even crossed 30.

    Can we conclude every one in this form has completed their voting about this topic?

    Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.

    USCIS doesn't stop the application process just because your PD is no longer current

    This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)

    "pending visa number" situation never possible now becuase there are sufficient I485 with old pds. PD is base after that every thing is luck.

    I think IV should work on filing a CLASS ACTION LAWSUIT for several reasons. Are we going to be coward legals waiting, for lazy folks at USCIS to undo the wrong they've done for so many years.

    1. Blatant errors in the processing which has, destroyed , causing huge stress, trauma and what not to ppl waiting in limbo.

    2. Inability to provide any insight on the basic timeline for any application. Look at the EB backlogs, they change there bulletin as if its a stock market, it can go forward or backward depending on the mood of the ppl working on any day.

    3. Immigration is a burden on the legal immigrants, we pay for those ppl jobs. How can they offer such a sub-standard service, considering the hefty fees they charge from us.

    4. The US constitution says " We the people", does not say "Legal Aliens" don't have any say or can't ask for justice.

    5. We are legals, did not cross any border like those illegals, which this administration is so concerned about. We pay for services, not screw ups!

    6. Lost EB visas for USCIS / DOS mis-handling.

    7. Even if we loose the lawsuit, still we made our point. USCIS sucks! period

    Ok now, i'm ready for all the red dots, who think that keeping quite will some how magically solve these problems. They need to be held accountable for what they've done.

    Hi,

    I need you advice.

    I have Labor and 140 cleared under EB3 (worldwide) and waiting for 485 to file. PD is December 2005. I am software developer/engineer

    I asked my company lawyer to file for EB2 since EB2 is current. This is what their response is.

    "DOL has come up with what they consider to be job classifications and separated those into the job zones. There are very few which make it to zone 5 and they include such things as surgeons, lawyers, physicists and the like, in other words highly specialized positions requiring a higher than normal education path and many years experience. There are no computer related positions listed under Job Zone 5. All our positions fall under Job Zone 4 which does not lend itself to EB2 filing. We can�t file under EB2 due to DOL restrictions to minimum requirements for positions."


    Is it true that computer professionals now can not file for EB2? Is there any way that EB2 can be filed? Is it not possible?


    Please help.

    As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months.4
