I am in the process of filling I-485 form and got the following question, can you please help?
My stamped visa expired 1 year back and I am currently with H1B approval notice. In the 2nd page of I-485 form, under Part 3. Processing Information, I am wondering what I need to fill for the following columns.
1. Nonimmigrant visa number: Is this the EAC number of my current I797 or the visa number from my expired visa?. If it is from the expired visa, there are multiple numbers in the visa stamp, which one is the visa number?

Btw, I've got mine I-485 receipt at Sept 13th, filed with NSC and was received by well known J. Barrett at 10-25 of July 2nd.

My labor was filed in July 04 on EB2, but approved under EB3 category only. My attorney contacted uscis to with the amendment saying that my LC should have been approved under EB2 category. Finally, got a letter from uscis in Feb 2007 that my LC was approved under EB2. Could that be the reason that I did not get GC yet even my PD is current.

He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.

Check with your lawyers. It should be easy to get an amended approval notice or atleast a letter from USCIS that it is okay.

I think it is the part of their process. I went an infopass the other morning and the IO gave me the same response. She said every thing was fine with my application. It was pre-adjudicated and now waiting for a review now that my priority date is current. She asked me to wait for 60-90 days. But I got the approval same afternoon :)
I was told the same thing in my infopass appointment on Sep 3rd. I also opened a SR on 09/01. Finally received the 485 approval notice on 09/10. My wife who is my dependent actually received a CPO email on 09/09 and a message on 09/10 saying "you are registered as permanent resident". I never received the CPO email and I don't care.
It's been a long 10 year journey, extremely frustrating. I case to this country as a student, then H1B, was exploited by my employers for so many years, still with the same employer on H1. Renewed EAD 2 times never used it as my 485 was denied last year.
Case history:
Priority date: Apr 26, 2006
140 rejected: Dec 2008.
I-140 reapplied Jan 2008
I-485- receipt date: 09/11/2007
I-140 approved Aug 2008 (Multiple RFEs which were never ending)
I-485 denied without appeal Jul 2009 because they somehow linked my case to a denied I-140.
Lawyer filed motion to reopen in Aug 2009.
I-485 reopened and went into pending status Jun 5, 2010
Here's what I did since the last month:
- Called USCIS to open a SR 08/15/10 but was told I should call when my priority date becomes current
- Called USCIS on 09/01, opened a SR for both myself and wife, was told I should hear back in 30-60 days, but may receive an email sooner.
- Lawyer called on 09/02: IO (Level 2) said, I may have to do finger printing again as they were expired.
- Took infopass for 09/03: IO was very helpful. Said my case was in transit and is pre-adjudicated. It was not assigned to IO as of that point.
- Contacted Congressman on 09/07. They initiated an inquiry on my behalf.
- Took another infopass on 09/10 (I wasn't aware that petition was already approved). Received the most humiliating treatment from the IO. She will not disclose any detail and told me I should come back in Dec to check on my status since my 485 was denied earlier. I ran into a Canadian immigrant who had the same experience - absolutely useless.
- Came home all frustrated and angry. I was surprised the see that the approval emails had popped in 8 am in the morning.
I believe the SR to request our files on 09/01 probably worked.
I can't thank enough the IV core and all wonderful people who keep contributing to this forum. This forum has been a great help!

no, the idea is; if you cry for gold you will atleast get silver. When the point is raised that people have been living here legally, paying taxes, ss, owning houses etc etc for 10 years!! What more is actually needed for citizenship?? The idea is to highlight that legal residents (many of them) have been here for ever!! 10 years is almost 15% of an average life span!! If only this thing is highlighted in some strong news papers. Isn't this protectionism at its worst. Us is complaining about labor laws in china???? What the heck is this here??? You pay taxes and ss and medicare etc for 10 years and then you are asked to leave??????????? Isn't this slavery??? Either take of the requirement that workers on visas have to pay the required ss / medicare etc or assume responsibility for having taken their hard earned money and let them in as soon as possible into the society.
somebody with skills in finding out stuff should research on how much money per year is contributed by the working h1b employees and given the numbers that are sent back how much is actually "stolen" from them. I once again say "stolen" from them. If they are sent back they should atleast be entitled to all the money that was "ilegally" taken from them.

To quote it in a much broader sense, America is not the end of the world - period! Just take it easy and enjoy life...don't freak out if the visa bulletin updates and you don't get to file your 485...we are all in this country by our free will..if we feel the rules of the land are not fair to us..each one of us is free to leave....
On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

when talking to my friends about IV I have observed the following:
1) they prefer to "visit" the iv site to get a first hand look at what IV is about
2) they tend to classify IV as a discussion forum rather than a movement - a couple of people have said that they did not notice any difference between IV and the other boards. they bookmark it and come back only when they have a burning question.
3) once i tell them about IV's achievements they do seem interested but most appear to be afraid (or lazy?) in actively joining - either monetarily or otherwise.
4) some people do not even want to post questions actively - instead ask me the question and expect me to post the question/ help them out with a response (not sure why - privacy issues?) - have others seen this also?
I don't know how to convince the lazy ones - but for the others, would it make sense to restructure the site a little bit so that the home page is a little less noisy and has only information about the underlying movement , IV's achievements and then has a link to the the message board (as a feature of IV rather than it defining IV)?
I think we are making a big deal of red and green dots. It is only in recent times that people are complaining so much about misuse. We can get rid of it, but then moderation will be tough. I do not think that is the reason for not participating. We do not have much awareness about IV in the community. When we say half million applications are pending, why are we not getting those on IV?
We need help in raising awareness about this cause in the community. Let us make that as the first action item this new year. All members can take initiatives and help. It does not cost any money and IV is not asking any money. We just need more participation.

Please i suggest everyone to wake up and smell the coffee/chai.
If you think giving us citizenship will be easy becoz it will prop up their vote bank think again coz it will never happen. Imagine the headlines which says recession time 10M americans out of job, foreign workers to get citizenship LMAO!
Forget this ever happening in a recession time and not much of a chance in the boom time either, see how the Anti-Immi's will eat everyone up for this ridiculous suggestion, please remember we're nothing in the larger scheme of things for the decision making people, we need to understand our limitation and strengths and play by them, IV does a decent job of that.

My current situation is that my wife and I applied for 485 separately.
my wife's PD is 2007 ( 485 applied in Aug 2007 )
I applied for 485 in Oct 2007, Since my PD is 2003 and is current as of now ( my 140 is pending ), I talked with our companys lawyer on what options do I have with regards to my wife's 485.
My lawyer suggested 2 options.
1. File 485 again for my wife as a spouse derivative. As per lawyer, this is very common and has experienced with these kind of situations.
2. Instead of filing a second 485 for my wife, just write a request letter to move her pending 485 to my 485 as a derivative. If this porting is successful, she cannot move back to her own 485.
I know some of us have gone with option#(1), but since option(2) involves very less paper work, did any of you have used this option so far?
I am confused as to which one to choose. My lawyer spelled diplomatic when asked about which option is better/safer:-)

In the email that you send to the streamline address, in the subject we have to write it in the format "I-485/MM". THe document says we have to write the month for "MM" but does not say whether the month is priority date month or the month that your PD will be current. What did you write?

more interestinly I am seeing that only Indians are being subjected to this name check crap , everyone else seems to be doing just fine
I have to disagree with that. Check out the names in the Writs of Mandamus lawsuits or the thread on Immig Portal about people filing writs of mandamus (http://boards.immigrationportal.com/showthread.php?p=173311)-- it is not "only Indians." It is anyone whose name, when run through FBI's name combination algorithm (http://www.cyrusmehta.com/related/Ayetes_Memo_on_Name_Checks.pdf) (see pg 2 onwards in link), generates a hit in the FBI reference files.
Just for the sake of illustration -- check out the names that appear in this google spreadsheet (http://spreadsheets.google.com/ccc?key=pBQx8tqZHHU2A6Q-Pv9sULw&hl=en) (you need a gmail account to view it) with a list of significant recent mandamus rulings.
