What is your PD? There is a portion of the memorandum that needs your child's age at the later of the date when PD is current or when petition is approved if PD is current by petition approval date.
I think you should submit an I-485 for your child as soon as possible or if the child is not in the US then file a I-824 immediately. This will serve as proof that your child "sought LPR status" within one year of your PD becoming current. Even if the 485 or 824 is rejected, you have established the fact that your child "sought LPR status" and leave room for administrative appeal in future.
This is just my 2 cents and I am not a lawyer. However, whichever way you interprete the new memorandum your child's CSPA age is under 21.

My PD is 31st march...so u will get the good news shortly. Minimum on my PERM were 7 yrs or Masters + 3 yrs
My EB-2 PERM got approved as well last week. MS + 6 yrs or BS + 8 yrs, S/W research engineer in mobile communications R&D. I work for a very large company (400k+ employees) and the attorneys were almost certain that my case will be audited. I am glad it was not audited because of high exp requirements that my job requires.

I am happy to report that within the first 4 days of this campaign we have already hit a potential fundraising total of $3,500!!!
We need to keep this campaign moving forward, we need IVians to support this cause! Our goal by end of Year 1 is $45,000!!! We need your support to make this initiative a success.

Do you know the story of the crow getting to the water by putting pebbles into the jug which had very little water?
Well, here we are: the water is IV's target...the pebbles are the contributions ($200, great, but $20, still good!!) from a large number of members. It's impossible to justify why one can not contribute $200 when the core members and some others like you & anurakt have given so much more. I believe it is equally important to encourage as many members to contribute as much they can.
No contribution is too small if it is actually made. An ounce of action is better than a pound of intention!
The weekness in this analogy is the absence of a time limit on the crow. If the crow will die by a certain time, then the crow better start putting bigger pebbles.
It will take 10 months to pay $200 if you pay $20/month. Legislation may start coming up in Feb. Money is needed to get the issue on the table and NOT when the issue is on the table. That time is right now.

I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
Nothing about this behavior is specific to Indians. It is a first generation immigrant behavior. See if you children are going to do it...
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
Really? An active lifestyle, being outdoors, energetic etc. are qualities of an American? A country where 70% of people are supposed to be overweight? Where some say 30% to 40% of schoolchildren are obese? I would agree with your argument for an active lifestyle versus a lazy one. However generalizing to things like getting up early/running/trekking/outdoorsy etc. as typical American traits is pushing it.
If I want to catch up on my sleep on the weekends, why not? I sleep less than 6 hours a day on average during the week. Sleeping less = poor output and also has been linked to poor cardiac health.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.
Money is not everything,a big bankbalance will do no good to anyone at age of 65 when you cant move your leg let apart run or play.
I also believe, we (indians) donot give time to ourselves. Ex. husband, wife, kids all together all the time. No good, give time to yourself, do somtihngs togehter and some things seperately, This will give time to observe life as an individual too.
You dont have to blindly believe that everything that is American is good.
For example, Americans work the longest hours of any developed country. Does this increase your standard of living. They have the fewest holidays/vacation days.
Maybe doing things separately is your "American way" of fun. Doing things with my family is my way. What's wrong with that. At least we dont have a 50% divorce rate and dont kick our kids out of our homes when they turn 18.

why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...
There may be some EB2 Indians with PD in 2002 and 2003 (with traditional non-RIR LC) got out of BEC recently. If 1,500 Indian non-RIR LCs (with EB2 PD 2003)certified recently from BEC, that is sufficent to move the date back to 2003 for India again. Having said that, it is all prediction. No one knows, except USCIS. My prediction is just based on the magnitude of 485s (800K) filed recently, as is has all kind of composition in huge manitude, apart from so many 485s already pending due to name check.

I'm just curious to know why Zoe Lofgen's website does not show this letter in press releases like her previous letters. The letter is awesome and has all aspects of a legal notice. Looks like she is going to sue USCIS herself on our behalf! :D

Look my friend, there is no logic like RD vs PD. If there were I would have had my green card before most here even filed their 485s. My 485 is pending for over 4 yrs now.
I have had people with PDs after me, RDs after me, all sorts approved and I am waiting.
This is a game of luck and chance.
The USCIS process is chaotic and disorganised in the way they do things. If you are lucky you get your approval earlier, if you are not, your application languishes in some salt mine in Utah or wherever else NSC stores their pending applications.

I believe this is going to work: Write letters and post them to your senators. Senate is in session, and all its going to take is a little spark.
In the past, we have sent emails and webfaxes to senators only to get canned- pre typed responses.
Recently, I have realised that senators favour written letters, posted (with postage stamp) especially if it comes from constituents from their state. Same with house reps. I have talked to my senator's staff and they have advised me to write a letter.
The staff member said, letters are always read, and responded. Senator will send an inquiry to the appropriate agency. This will create an impact, all of us should write letters.
