Yes, since H4 is tagged to your H1, you should receive your H1 approval too...Yes, you will be receiving a I-94 too along with the approval notice..The I-94 should be attached in bottom right corner on your approval notice. If you dont see an attached I-94 to your I-797 approval notice, then you will have to leave the country before your current I-94 expires and re-enter by getting a visa stamped..

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.

Having to wait 10 years for mere permanent resident status in a country in itself is ridiculous, compared to processing times in countries such as Canada, and Australia.
If anything, the period should be much shorter - about 3-5 years from entry as H1B (or any other work visa).
It's critical that the time start from date of entry with a work visa - not filing of labor certification/I-140/I-485. Many folks may have had to change jobs multiple times (for example, during and after the .COM bust) and the process would've restarted each time.

They will still do all the work needed to approve your application even when it is retrogressed. But, they just will not issue the actual Green Card until the dates go past your PD again.
You can remain on H1 until such time or use ur EAD and renew it on a yearly basis. The choice is yours based on your circumstance.

Possibly not. But it has to reach USCIS and I was thinking of getting through the liason process of the senators / congressmen.
If IV can take up this effort, then there is a channel that we can get through. But I dont think it is going to happen, because of the infights. Even if USCIS does'nt react, we can use this process to challenge the intrepretation and show them the mess that they have created. May be that will help

Why do I get a feeling you are incapable of digesting the concept of "Law of the land". There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law�s , and that too very slightly. I do want every one to have easy access to GC. Here what you are asking does not serve any one. It only increase the backlog. If we could make them utilize unutilized visas, remove country cap, set a fixed time frame, for most part I-485 would be current allowing any one with approved I-140 to file for I-485. You might say that atleast they could get EAD and AP. But look at those who already have I-485 filed. We are all crying the our applications are there for long time. So, do you still think to have AOS even PD is not current??

1. Get a "Non-Available Certificate" from the municipality
2. Get 2 people to provide affidavit (close relatives) in support of your birth date.

Perhaps we can refer USCIS to some of the rogue lawyers we deal on a daily basis. They will have to talk to the lawyer's paralegal, get an appointment to talk to the lawyer after 48 hours and get a lousy half ass written response prepared and that too a week late.

No. Last year we had an RFE as my wife's medicals were missing a signature. As Pappu mentioned in another thread most of them were pre approved and were waiting on visa numbers I think.

Dependent should be removed from the cap or the primary applicant should be able to bring the dependet to US with some kind of visa while the primary applicant is using EAD/GC(its ok if this visa does not allow the dependent to work in US untill the PD becomes current and his/her 485 is filed)
At present there are many singles/married who are not switching to EAD in order not to jeoperdize the spouse H4 visa.
