    Hi everyone,

    My friend is filing H1B visa from his employer which is a non profit organization. However since he is the only one that organization has ever filed H1B and according to him that his employer is only filing BCIS form I-129.

    Dont the non-profit organizations have to follow the regular procedures? Of what I know these are the procedures for filing H1B.

    1. Wage Verification
    2. Filing Labor Certification Application (LCA)---Form ETA 9035
    3. Approval of LCA----hard copy sent to the employer
    4. Employer posts notices
    5. Filing H1B visa petition, Form I-129
    6. Waiting for approval.

    His employer filing I-129 straight way, without following the other procedures, I was curious that things are done a little different for non-profit organizations- are they?

    Is there a difference in procedure (except for the $ 1000 fee) of filing h1b between profit and non-profit organizations?

    Any suggestion in this matter would be greatly appreciated.

    All those who answered were right! You don't have to reapply H4 for your dependants when you change employers as long as their current status is still valid. I changed employers in 2004 and didn't have to apply new H4 for my family until 2006 when their previous status expired.
    On another note, one does not need a new visa stamp in passport when one changes employers until current visa stamp expires.
    I hope this puts your mind at rest. You may however want to confirm this with your lawyer and post his answer.

    I am happy that this thread is live again after 2 years (I started this in 2008).
    Thanks for starting this thread. The next 2 years should be the right time to pursue this I feel. With EB2 approvals picking up at a good rate and the good predictions by qeshmk, TeddyKochu etc in other threads, it gives hope to many of us. Hopefully our fellow EB3 friends also get their approvals by mid 2011. Given the recession in '07, '08, we don't see too many new apps files for ROW in that period, so hopefully we'll have some spillover again in FY'11. That should help both EB2 and EB3 categories.

    Having said that, this will be the right time to purse this agenda...Many of the folks suggested, counting date for citizenship from I-485 receipt date or I-140 receipt date. If you google 'Backdate GC', we can see that many other folks in murthy, rajiv khanna forums are also talking about this. So, we might have enough members to pursue this further. Many of us have been here close to 10 years (Me from 2000 on F1, OPT, H1B etc). Its only fair to have some of those years counted towards citizenship.

    Hi,

    I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

    My last one filed on April 2. In "Process". Whether filed onlined or mailed, PERM is processed by DOL federal centers in Atlanta and Chicago, as far as I remember (mine went to Atlanta -the number starts with "A). Why is the guy talking about particular state? Only PWD is acquired from the "state workforce agency"( the actual names differ between states).

    Very true - anyone who goes ahead in the queue is actually easing it up for the latter. This is Never about belittling a fellow sufferer.
    If PhDs get a quota relief, will be good for all of us, although i personally will not qualify.
    US Bachelors/Masters holders in a STEM field for example, will similarly ease up the system.
    Hopefully all others will see it that way.

    If there is anything targeted for any small group...I am sure other will not accept whatever may be the reason. Everyone desperately wants to get out of this mess. I don’t think freeing up the queue theory will help. That’s the reality.

    For the shake of argumennt let me ask you...If I get my GC, it will free up one GC in line. Will you accept that and support this. This is the question in everyone's mind now.

    My wife is in India for the last year to get new H1-B (6 years completed)
    She has a valid dependant visa till May 2008

    Based on new rule, she applied to reclaim 3 years of H4 for H1-B.
    H1-B is approved, she is going to Chennai, India for stamping.

    If for some reason H1 is denied, can she come back as dependant?


    Yes ..she can use H4 if H1 is denied. Make sure consulate don`t cancel the H4 visa and the time of H1 B visa interview.

Mr. KERRY (for himself, Ms. Snowe, Mr. Sununu, Ms. Landrieu, and Mr. Lieberman) submitted an amendment intended to be proposed to amendment SA 112 submitted by Mr. Sununu to the amendment SA 100 proposed by Mr. Reid (for Mr. Baucus) to the bill H.R. 2, to amend the Fair Labor Standards Act of 1938 to provide for an increase in the Federal minimum wage; as follows:


    In lieu of the matter proposed to be inserted, insert the following:

    SEC. __. RENEWAL GRANTS FOR WOMEN'S BUSINESS CENTERS.

    (a) In General.--Section 29 of the Small Business Act (15 U.S.C. 656) is amended by adding at the end the following:

    ``(m) Continued Funding for Centers.--

    ``(1) IN GENERAL.--A nonprofit organization described in paragraph (2) shall be eligible to receive, subject to paragraph (3), a 3-year grant under this subsection.

    ``(2) APPLICABILITY.--A nonprofit organization described in this paragraph is a nonprofit organization that has received funding under subsection (b) or (l).

    ``(3) APPLICATION AND APPROVAL CRITERIA.--

    ``(A) CRITERIA.--Subject to subparagraph (B), the Administrator shall develop and publish criteria for the consideration and approval of applications by nonprofit organizations under this subsection.

    ``(B) CONTENTS.--Except as otherwise provided in this subsection, the conditions for participation in the grant program under this subsection shall be the same as the conditions for participation in the program under subsection (l), as in effect on the date of enactment of this Act.

    ``(C) NOTIFICATION.--Not later than 60 days after the date of the deadline to submit applications for each fiscal year, the Administrator shall approve or deny any application under this subsection and notify the applicant for each such application.

    ``(4) AWARD OF GRANTS.--

    ``(A) IN GENERAL.--Subject to the availability of appropriations, the Administrator shall make a grant for the Federal share of the cost of activities described in the application to each applicant approved under this subsection.

    ``(B) AMOUNT.--A grant under this subsection shall be for not more than $150,000, for each year of that grant.

    ``(C) FEDERAL SHARE.--The Federal share under this subsection shall be not more than 50 percent.

    ``(D) PRIORITY.--In allocating funds made available for grants under this section, the Administrator shall give applications under this subsection or subsection (l) priority over first-time applications under subsection (b).

    ``(5) RENEWAL.--

    ``(A) IN GENERAL.--The Administrator may renew a grant under this subsection for additional 3-year periods, if the nonprofit organization submits an application for such renewal at such time, in such manner, and accompanied by such information as the Administrator may establish.

    ``(B) UNLIMITED RENEWALS.--There shall be no limitation on the number of times a grant may be renewed under subparagraph (A).

    ``(n) Privacy Requirements.--

    ``(1) IN GENERAL.--A women's business center may not disclose the name, address, or telephone number of any individual or small business concern receiving assistance under this section without the consent of such individual or small business concern, unless--

    ``(A) the Administrator is ordered to make such a disclosure by a court in any civil or criminal enforcement action initiated by a Federal or State agency; or

    ``(B) the Administrator considers such a disclosure to be necessary for the purpose of conducting a financial audit of a women's business center, but a disclosure under this subparagraph shall be limited to the information necessary for such audit.

    ``(2) ADMINISTRATION USE OF INFORMATION.--This subsection shall not--

    ``(A) restrict Administration access to program activity data; or

    ``(B) prevent the Administration from using client information (other than the information described in subparagraph (A)) to conduct client surveys.

    ``(3) REGULATIONS.--The Administrator shall issue regulations to establish standards for requiring disclosures during a financial audit under paragraph (1)(B).''.

    (b) Repeal.--Section 29(l) of the Small Business Act (15 U.S.C. 656(l)) is repealed effective October 1 of the first full fiscal year after the date of enactment of this Act.

    (c) Transitional Rule.--Notwithstanding any other provision of law, a grant or cooperative agreement that was awarded under subsection (l) of section 29 of the Small Business Act (15 U.S.C. 656), on or before the day before the date described in subsection (b) of this section, shall remain in full force and effect under the terms, and for the duration, of such grant or agreement.

    Hello Gurus,
    I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
    After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.
    Please help.

    It is encouraging to know that your case is assigned to an officer that you raised an SR on Aug 3rd. An SR was raised for me on Aug 3rd as well and the customer service rep mentioned that my case is also assigned to an officer...

    So, Will Aug 18th be "the day" to look for ?? :D

    That would seem to be true. I am hoping that our cases will be approved even before that. I have exhausted everything that I can do except for Ombudsman - which I want to keep as last resort.
