I know your pain, Iam in the same boat, submitted everything on 06/26, hopefully everything will be filed after july 4th.
I have submitted all the documents to my laywer on 6/25 itself (including medical) but they are just heavily back logged and won't be filing my case till Jul 10. I am just frustated now. I even offered to pay extra to speed it up but no use. I am only worried if dates retrogress half way through?
To my real question.. Can we just file on our own with out the lawyer? I would hate to loose this window just coz my laywer couldn't do it. Not sure how I would break that kinda news to my wife, "I know the dates were current for 10 days in July but our lawyer didn't have time so now you will have to stay at home for 1 more year".

Here are my questions:
1. If some company would like to sponsor a new H1-b visa for me in the next several month, will it subject to this year's h1-b cap?
No, you are not subject to H1 cap.
2. Recently how long does it take to get an H4 application approved (my appliction is processed in Texas Center)?
No idea.
3. It is possible to file a new H1-b application before my H4 approved?
Better consult a lawyer.
Very anxious right now. Any help/information/suggestion will be highly appreciated!![/QUOTE]

Will contribute again.
Even thinking most selfishly I can only think that contributing to the Advocacy Efforts will only save me money in the long run. Just imagine if I get my GC one year earlier due to these efforts - How much I will save -
No EAD for me and wife - Savings of $340 per year
No AP for me, wife and Son - Savings of over $1020 a year ( I always apply for AP
every year bcos I can't imagine being stuck here if there is an emergency back home)
This amount is only for one year - if GC drags ( most likely will.. without Advocacy) - do the math.
I feel contributing couple of hundred dollars is the least I can do.
I sincerely urge everybody to contribute whatever amount they can small or big -
Little drops of water make a mighty ocean (cliched it might sound but sums it up perfectly)
Just think you and your family had dinner at a restaurant this week. :)

May be we can also try to reduce the retirement benefit age from 65 (or may be 67, or 70 I really don't know, whatever it is) 60. That will be tremendous help for early retirement. What do you say Mr/Mrs. Saralayar?
Good idea Mr/Mrs. gc4me.. Keep it up... Think... think... and come with such innovative ideas.... You can only think this much....

Labor filed in Aug 2002, approved after 6 years in June 2007. Meanwhile, our son aged out in June 2004. Daughter turned 21 today, and her I-485 adjustment application is in the July 2 logjam.
The DREAM Act can be a solution for our son, but some of the versions were made applicable to only illegal immigrants. We have to be careful to read the details whenever the next version makes its headway in the Congress.
I honestly do not hold out much hope for the dream act giving any benefit to legal children, and also doubt it will pass anyway.
Lets see what we can achieve as a group, if we get enough people to agree to help us

Has anybody got any movement on their Efiled EAD around April 19th? I had sent my paperwork to TX. As of now my status shows Initial Review. No FP has been ordered also, which I did last time when I renewed my EAD 2 years back.
Anybody facing similar delays?
I have seen a lot of people getting their EAD's approvals with in 2-3 weeks.
I will really appreciate if folks can share their time line.
Thanks for the help.

Here is the reality: The thread is 2 years old and we have not had a group of motivated folks who could commit both time and money for this. In the last 2 years thousands have read this thread and have got greencard, but after getting greencard most people have different priorities in life. Writing posts on the forum asking IV to work on it will not get anything done on this issue. Nobody else will do anything unless those who seriously want to work on it commit their time and money for it.
They need to be going to fund raisers of lawmakers and contributing to election campaigns etc as a first step to lobbying. We need to see IV green card and citizen members doing this more regularly anyways to help others in line behind them and get more politically active.
Few things for GC holders to know:
++++++++++++++++++++++++++++++++++++++++++++++++
Can non-US citizens contribute?
Foreign nationals are prohibited from making any contributions or expenditures in connection with any election in the U.S. Please note, however, that "green card" holders (i.e., individuals lawfully admitted for permanent residence in the U.S.) are not considered foreign nationals and, as a result, may contribute. For additional information, consult our "Foreign Nationals" brochure.
Read more : http://www.fec.gov/pages/brochures/foreign.shtml
+++++++++++++++++++++++++++++++++++++++++++++++++
Here is how people can organize this effort:
If some green card holders seriously want to work on this issue, the first thing they need to do is form a team. Commit for a long term effort. This is not going to be an effort for a few month or days but will take several years. After you form a team, the next task would be gather as many people as you can who want to work on this issue and wish to meet lawmakers. You will also need start-up money to work on this effort. This effort is not as simple as fixing green card backlogs. If we are thinking working on this effort will be as simple as writing emails, then it will not be worth spending time. Be prepared to personally go and meet lawmakers in both your area and DC every couple of months. IV core team has been making trips to DC every month for past 4 years and only then we have been able to bring our issue in focus.
Citizenship rule change would change the INA and would require lot of support from H1B community, Greencard holders and citizens. It would require lot of funds too. Be ready to contribute your own funds (not hundreds but more than that to start) to run advocacy tasks. IV site is just a platform with a web-forum, but the real work that costs money is daily advocacy operations. Running is site is not expensive. Once the effort gains momentum, you can raise from IV forums from other Greencard members as a separate pool just like we did for FOIA.
At this time IV does not have the bandwidth or resources to work on this issue. Our primary focus is fixing greencard backlogs so that our members are out of the Greencard Queue. We started this organization for this purpose and we wish to finish what we started before we take on any new effort. Even though some core team members have Greencards, we are all committed to work on Greencard backlogs and will not work on other agenda items in our limited time. It will have to be a parallel team within IV that can work on this issue. IV team can guide as needed but we simply cannot divide our limited time and resources on a new effort.

I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,
For 2nd Case should we file by mail, providing certain reason with the application?

Does anyone know that if it's an India-issued passport and if it's about to expire, will I get the new passport the same day if I submit the application for renewal in person to the CGI/ Indian Embassy at Houston/ NY?
At NY you may get same day service using Tatkal option ($90 extra) . You can tell them you need same day service. They will examine your passport and let you know if they can renew it the same day or not. You can then pay the $90 tatkal fee and collect the passport the same evening.

Thanks Sandy. Appreciate it.
Does it mean that now if the denial is appealed by my attorney, then my case will go to some Backlog Processing Center, or it'll still stay with Atlanta National Processing Center?

Can someone please create a poll for ROW RDs. It should be monthly banded
between May to Aug 2007.
I don't find an option for me to create a poll.
Your long wait at the ticket line is over, now sit back, relax and enjoy the game :D
BTW, does anybody here know is there a percentile or graphical ROW RD distribution out there? Please post the link here. Would love to see how many 485 applications for ROW between June to August 2007.

E. EMPLOYMENT THIRD PREFERENCE VISA AVAILABILITY
Demand for numbers, primarily by Citizenship and Immigration Services Offices for adjustment of status cases, is expected to bring the Employment Third preference category very close to the annual numerical limit in June. As a result, this category is likely to experience retrogressions or visa unavailability beginning in July. Such action would only be temporary, however, and a complete recovery of the cut-off dates would occur for October, the first month of the new fiscal year.

Filed for renewal on 04/05 and still waiting for receipts. Current EAD expires last week of July and am running the risk of losing my job if I don't get it by then.
Does anyone know what are my chances of getting it before then? Also, what are my other options at this point or before I lose my job. I read about interim EAD's on other posts, is this still an option?
Your response is highly appreciated.
Sincerely.

There are lot of support and response for this thread and can Core IV team consider this to be included in their Phase 2 campaign?. It will be an added feature for our to be legal immigrant community. ^^ Bump^^
Great Idea. Since this is Saralayar brain child, let us all nominate him/her to lead this venture , while us IV followers pursue more servile task's like trying to recapture visa numbers, get multi year EAD's and basically save our B*^$'s.
If this venture is a success Saralayar will be a citizen in a year (along with a few side kicks that are backing this new citizenship concept) or so and then he/she can push congress to pass the other minor legislation that will bail the rest of us out.

I talked with my lawyer yesterday, was informed that American immigration lawyers association (AILA) is filing for a class action lawsuit against DOL. There has been about 40% cases that are getting audited in Atlanta center. But after replying to queries, the center is not responding on a timely basis. There is light at the end of the tunnel.:)
# 5/15/2008 Atlanta National Processing Center Audit Survey
The AILA DOL Liaison Committee is gathering information about the increasing backlog of audited cases at the Atlanta National Processing Center (NPC). Please complete the brief survey of PERM audit processing and share your experiences with any audited case you have which is still pending at the Atlanta NPC. AILA Doc. No. 08051560.

Please check my previous post on this and reply from Ron Gotcher on AILA law suit. Let them do and we can also continue what we are doing. As long as we the desired result I am fine

I am seeing several people contacting Congressman and opening service requests. These guys seem to have become current just this month and they do not have any patience. It is crazy in my opinion. As pointed out earlier there is lot of herd mentality on the forums and if one person posts, everyone else does the same. Some people I have seen on the forum call customer service every day to get case status. I urge people to read and try to understand the process than blindly following what others are doing. Secondly as posted earlier, tracking is also useless and a waste of time. It will not help you get your green card any faster. Have some patience and follow the process. Starting a service request as soon as your date gets current, cannot help you.
