Can i file it myself ? i did talk to a lawyer and she said we need a document from a company saying that the position is still open before we can file I485 by myself.

Unfortunately your lawyer is correct. You can't file 485 (even if you have copies of labor certification or I-140) on your own without a letter from your current employer explicitly stating that the position posted in labor certification will be open at the time when you get your green card.

The IV bus journey from NJ was very well planned and executed. All I had to do as a "participant" was indeed to just hop on....no fine print! On the bus and at the rally made some wonderful friends.
singhsa3, mpada and everyone who may have worked on the NJ/NY bus logistics, you have been excellent! Thank you IV core for providing this convenience.
IV handle "laborchic" who was on our NJ bus co-coordinating the minute details of to and fro journey with help from another selfless soul "amit_sp”, superbly handled stopovers, timings, ensuring that we reached rally on time and also more importantly that 'No child (read registered bus member) was left behind' and keeping driver happy etc....
Special thoughts also go to whoever came up and arranged the idea of the Gurudwara stopover during the forward journey. It was simply superb! We were able to catch up some sleep there and were fresh for the rally. The host at the the Gurudwara was most gracious. The facilities were good. We were grateful for the lovely breakfast and tea that was served.
The rally was very well organized, right to the minutest details. It was a wonderful effort from some really tired but focused and determined looking volunteer folks whom I saw scrambling around while we participants had it easy. During the rally got a good view of the Capitol Hill and other spots. The cops on motorbikes, cars and bicycles monitoring our procession looked an awesome sight. But that paled compared to the feeling of camaraderie and friendship that was overwhelming all of us folks in white IV T shirts.
Also saw faces behind IV handles, the core and other ever active ones, and found out that they were just like me, two hands two legs.... no horns or feathers. Realization then struck that what probably differentiated them from a lot of us was simply that they have reacted to the same problems you and I have in a smart, constructive and selfless manner.
This is what I could remember and share with few of you who unfortunately could not make it and a whole lot of you who did not make it. To the latter, the feeling of high I have now from having acted upon my normal demons is something I am not able to describe. I just feel it......

I am looking for advice on the strategy for filing the third phase since the PDs for my wife and me have become current. My PD is Feb 2003 (EB2) and my wife's is June 2003 (EB3). My wife and I are on 8-th yr H-1B extensions with approved I-140s. Which strategy makes sense and are they even valid? The objective is to go with a risk-free strategy that gets us the GC in the quickest manner.
1. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for I-485 (AOS) using her PD, with me as dependent.
2. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for Consular Processing using her PD, with me as dependent. OR vice versa.
3. Any other option?

Counsular processing(CP) or AOS is determined according to individual situation. It depends on Job-stability, lot of factors. you should do what works for you after careful evaluation, not hedge your bets by doing 2 applications. Just do one way, either use your PD or your wife's and do one application for I-485. Whichever has the best chance with the lowest rate of RFI. whoever wants to stick around longer in their job (you or wife?) should apply, it will take a year+ for that person to stay in the job before final physical card and then 6 more months. Talk to your attorney.

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. We would have loved to pick the NYC ING Marathon, but it would be quite a bit of a challenge for us to coordinate Team IV participation at an event where the registration is controlled via a lottery system. We would like to get our first year successfully under our belts, and then we will certainly look into revisiting NYC's marathon.
The three events picked for 2008-2009 year are spread out across the US and they provide us with a range of distances to walk/run. I have spoken to the race directors and we are ready to coordinate registrations with them. I hope you will join us in our first year.

Pattern seems to indicate - ND and no complications, leads to approval! PD does not seem to hold any relevance as long as it is current! All of those who filed in 2007 and are current - will likely get it this month! Those, like me, who filed in last year's window can hope to get it by next year!

Not sure how this two application thing work, but doesn't this kind of situation trigger unncessary confusion with finger printing etc.?
As far as I know, when USCIS collect the Finger Prints everything will be in the same database and the name check, back ground check etc. starts from there. If you apply two applications then you will get notifications twice? Unnecessary risks and confusions, if I were you..I wouldn't do this.
USCIS is so unpredictable, what if they do back ground check twice and create some weird confusion or one of you get stuck unnecessarily? This is a very confusing scenario. Talk to your attorney.

I am surprised to find out that someone is still trading in the stock market. It seems CNN just reported that everyone who used to trade stocks have declared bankruptcy or were thrown in jail for running a ponzi scheme, so no one is left in the stock market. Supporting documents received on Apr 28th.
Received EAD receipt on April 30.
Last year I remember receing the receipt and biometric appt letter together.
Has anyone who efiled for EAD renewal this year have received biometrics appointment?

I efiled ead petitions for both myselft an my wife on April 19th. I received the approval and the card on May 1st for my petition. I did not receive any biometric appointment. I have done efiling last time too.
however my wife did not get her approval yet although both of them were filed on the same day. had some luds and then no updates since april 27th.
