Hello Gurus,
I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.
Please help.

I met pappu for the first time at the reception registration, and someone had to point out to me that it was him heeeee. Honored to meet you!
pdakwala, you are the best, you were the one who called me and tried to get AA to waive the change fees for me, and I had really looked forward to meeting you. It is plainly evident that you guys really care about your members.
Paskal, I had seen your picture before, so I knew it was you. You made us walk all the way back to the starting point by which time all the cleanup was already done!
MACACA IS REALLY MY CHACHA NOW :) I couldn't stop shouting MACACA randomly. I think I even shouted PAPPU out of dhiren's car.
Aman, I couldn't believe how everyone was approaching him for all the pettiest of things (including myself) and he always obliged.
LogicLife is too proud.. he didn't take the rose I offered him during the rally. I don't want to have anything to do with him now!!

some wonderful people had already arrived there and we were able to start clearing the place out thus depriving you and texanmom of the pleasure of lifting placards and water bottles and so on...too bad...next time walk faster :D:D
i want to say this...lots is being said about local guys not coming and all...but the local team that did show up and ran the host program and were marshalls and helped clear the two grounds up..were simply too good.their efforts went a long way in making the whole event a success.

Waiting is all we have been doing for so many years. I have been living separately from my wife for last 3 years. When I reached out to Pappu on IV, he refused to do anything for me. I am ready to come forward and talk to media but nobody is here to listen.
I am seriously considering some media awakening event these days, it might be suicide or whatever it takes but this DOS stupidity has to stop. Its affecting so many people's life. I agree GC is not a right that we can demand from US government but they can't treat us like this after investing so many productive years for this Economy.
buddy...your quote kinda worries me. I can understand what you have gone through but always remember there are good things to life beyond worrying about this GC mess, following visa bulletins, and subsequent frustration/high bp/heart attack.
I do what I can to educate the people around me about this legal immigration limbo and whatever within my control. I suggest you chill and use your energy positively to benefit yourself.

Unfortunately your friend is correct - the alternate I can think is withdraw your present application and file I-140 and I-485 simultaneously now - other please tell whether this will be a good approach for their benefit. Can EB3 file concurrently I 140 and I 485.
But how to revoke an already submitted I-140 Eb-2?
By the way, many a time such a case would be issued an RFE and then you could change (not aware of the exact terminology for this) it to Eb-3.

Just checked again and the last 2 approvals are
PD 3-15-05 RD 6-12-07
PD 10-21-04 RD 6-29-07
So they are past the June 8th date, looks like they are still processing pre PERM applications though.
PS pappu, I updated what I know exactly (PD RD of I 485), my lawyer has the rest.
I have received approval on April 04 and today I have received GCs for all my family but not for one of my daughters. I checked USCIS and I just realized her application is still pending. She just turned 14 on March and she only did FP 2. Do you think she has to do again FP or they just left her behind......

Its very unfortunate, that most of us are very active only when a Visa Bulletin is released, bickering about EB1, EB3, EB1 etc. Then the topic dies until the next visa bulletin is released.
There are plenty of action items to do, have you checked those, I recommend you do that ASAP. Mind that the IV core also has a professional and personal life, no one pays them to do what they do at IV. Simply pointing fingers at others will not help with our cause. Contributing some $$ is also an action Item, I suggest you start with that.

i fully support eb3 becoz their backlog and pain is more severe...... but fragmenting everyone in smaller groups..... like eb3 v/s eb2 v/s eb1 will not fix any problem...... i think there are anti-immigrants or people from other tracker websites who create fake ids to make people to fight with each other..... look at this eb2_unite guy..... she/he created his id today and is suggesting creating a new group of eb2...... i know for certain ..... 1000% certain that he will not do anything about creating a group...... he is writing inflammatory posts so that people here are divided and continue to talk rubbish......

If you are a staunch supporter of the EB3 cause, it is your prerogative, but you cannot expect every EB2 person to fall in line with your thoughts and call them traitors. Is it a sin for EB2 people to join together and protect their interests and represent their case? Is it not democratic? What way is it inflammatory or legally wrong? I am only asking those EB2 people who feel that they would be affected to ponder over the impact of a re-interpretation. There is a legal avenue to port from EB3 to EB2. Eligible EB3 folks can certainly port to EB2 and get benefited.
A few EB2 and EB3 folks have spoken logically about working unitedly towards visa recapture. No one seems to listen. I am willing and keen to support the visa reacpture. That is a positive approach. most companies either want to hire contractors or outsource work so your statement "about real jobs for real employers" is not correct. The people working as contractors are infact working on real jobs for real US employers. Not many companies are willing to hire people on H1 on a full time basis because of all the costs associated with the H1 processing not to mention the paper work. They want to contract employees in general and not give full time jobs. If desi bodyshops are punished this way, then all of us will also be punished. and thats exactly what Ron hira wants.
This would actually be a good idea. Then there would be more Visas available. Especially people with US Degrees. Most people with US degrees dont need to work for this fraudulent consulting firms. They are able to find real jobs with real US employers.

I'm all for this. This is very close to my heart. I probably care more about this than I do, my 485 approval.(can't have one without the other, I know I know. But still.).
I don't know when I'll get my 485 approved, hopefully within the next year. But I'm willing to work on this, whatever it takes - contributions, lawmaker meetings, DC.

This has got to be simple too. When the citizenship law was first drafted, immigrants got their green cards within months of entering the country. Start to End of the greencard process took under a year, if not less.
The intention of the law was to have them learn the language, the ways of the country, and assimilate, which was expected to take about 5 years, before applying for citizenship.
These days the green card process itself take over 5 years for a lot of people. Most Indians and Chinese in the EB2 category, and pretty much the entire EB3 category have lived here longer than 5 years. In those 5 years they have gone to school here, paid income taxes, bought homes, and learned the language (well they had to, in order to qualify for an employment based green card!). What more "assimilation" do they need to do?
I definitely think that the following should be the criteria for eligibility to apply for citizenship,
- An approved green card
- 5 years of continuous U.S. residence starting from the date the 485 application was received.
Let's do this.
