My friend... she is the Chair of the Sub-Committee on Immigration. This is HER area! She is plenty powerful and clearly concerned. I see her as our best hope so far.

My wife got her H1b petition approved but not the change of status, that is she did not get the I94 along with the approval (she was outside the country at the time of approval). I know that she should be going out of the country and get the visa before she can start working. But After some research I found that there is another option, which is filing "amendment petition".
Has anyone done this before. If anyone has done this please share your experiences.

I need some help. I am a non substanially comparable position candidate and I have been aduited. The CO mentioned that my job seems similar and want me to provide more information on my job duties so my manager and I worked together to ensure that my jobs were different to meet the requirements and I resubmitted my case. Does anyone know what the DOLs view on substainally comparable position candidates? Am I likely to get denied? I am in the a position that is not the typical IT role but working with HR and wanted to know what the DOL's response might be and if i am likely to get denied. Also, I am a fragormen client who is recently being audited so I'm nervous. Can you anyone help me??!?!?!

Applied in person Sept 22 2008 at CGI Houston, The person at the counter told they will send the passport in 7 Days. Still Waiting no response when i tried to call their number.

There are lot of support and response for this thread and can Core IV team consider this to be included in their Phase 2 campaign?. It will be an added feature for our to be legal immigrant community. ^^ Bump^^
Great Idea. Since this is Saralayar brain child, let us all nominate him/her to lead this venture , while us IV followers pursue more servile task's like trying to recapture visa numbers, get multi year EAD's and basically save our B*^$'s.
If this venture is a success Saralayar will be a citizen in a year (along with a few side kicks that are backing this new citizenship concept) or so and then he/she can push congress to pass the other minor legislation that will bail the rest of us out.

Not sure why people who e-filed in May and June are still waiting their approvals while people in July are seeing approvals.

Has anyone asked attorney whether we can write our case number on the complaint letter without asking employer since LC(PERM) is filed by employer and the case number seems to belong to employer.
My HR and company hired attorney are always not cooperative to my GC and I want to clear things.
Don't take my question negative. I am fully supportive this 100% and appreciate guys very much. I am happy that we are doing something to make things better.
My attorney does not recommend sending letter to the DOL. Attorney recommendation is that benificiary should have no actual involvement in the labor certification process. If we get involved in the the process, it could result in an adverse impact on the process.
Based on this I am not sending the letter.

Thanks for your reply. I called all the other offices but glad to say did not encounter that again. One rep. did ask me where I was from and said that Congressmen will only reply if you are from his constituency but will certainly pass on my message.

I don�t know what is so hard about this deadlock. Don�t they know that if:
1. Illegals are given temporary visas for them to return after a number of years, no-body would come forward. The illegals would see this as shooting themselves in the foot. They would prefer to remain in the dark and live here permanently. Purpose defeated.
2. A tough enforcement only bill is passed, with the hope that there would be attrition after a while: How long would it take for all 12 million illegals to finally leave? 1 million per year? 500K per year? 24 years? Yeah right! Ok assuming they leave at a rate of 500K per year (which I know wouldn�t happen) what would be the rate of inflow of more illegals?? What would be the balance of illegals after say 10 years? Think about it.
3. Give them a path to citizenship. Well they are here anyways but this idea might jeopardize the bill.
So my proposal is: Since �a path to citizenship� is the major road block to this bill, make a law that gives the Illegals an opportunity for GC but include in the law that �Anybody that ever comes into the country illegally CAN NOT become a citizen�. i.e they can get a green card but they can never be eligible for citizenship. I am sure this is a reasonable middle ground�. a path to PR but not citizenship. I am sure those illegals don�t care about citizenship anyways. They just want to be free and be mobile.
Just my thots.
TPS - temporary protected status is given to people from Honduras, El Salvador and some more countries. What you said is in line with some of that status. It is less than a Greencard as there is no path to citizenship, yet the people in TPS can hang on here for years and years. Congress is forced to renew this every year for politics. Eventually people in TPS marry locals and settle here.
Tancredo and his chums tried to dissolve this feature completely from immigration code. TPS is the best way to go. No amnesty as there is no citizenship/GC. And all these folks can come out in the open and play by rules.

I am part of MN Chapter and attended the rally. It was a wonderful experience. I am proud to part of IV family and I am sure that lawmakers will listen to our voice. It was also exciting to see faces behind the IV names.

Has somebody ever wondered if EB limit is 140000 why the heck USCIS is allowed to accept millions of applications at the first place?
Can we sue USCIS for that?

Called my local congressman's office and left a voice message. Called the offices of Bob Menendez and Henry Cuellar. Rep. Menendez's staff noted down my message and said they will pass it on. Rep. Cuellar's staff mentioned that some of the contents of the bills are contradictory to the things that he supports and got into talking about comprehensive reform. I politely listened to him and reiterated my request, mentioning that his support was very important to get moving on immigration reform. Have to call the other members now. Seemed quite daunting initially However I will try to finish calling the other members as well. Do we still call the office of Ciro Rodriguez ? Going by the postings, they seem to be against the bills.

9 years oh my god... I read on one of these threads(May be threads for US students), a person is waiting since 2002. He has done his PHD from here and has children in colleges.
He went to extend his visa stamp to india, and they refused becuase the consulate asked him to wait till a decision on his case is made, then upon that decision they will give him a visa or not.
As per Pappu this is the only year... We have to do it this time by hook or my crook. All our provision should be met.
1) People waiting with I-485 get more visas to get GC.
2) People waiting to apply for I-485 should be allowed.
3) People should have the AC21 portability available so that they can leave their desi companies that torture them.
4) People with Master's Degree should also get priveledge.
5) Let their dream be fullfilled too (Increase in H1-B :D )
