Today I have contacted Ron Gotcher and here is his response.
1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.
2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.
3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.
And also Ron Gotcher ready to help us.
So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.
1. Rather than every one sending separate letter, let us send only one letter and every one signed that.
2. Let us create one yahoo group, send all your infomation, Name and adress.

4. Based on the response let us decide our next move.

Each Passport is unique and will have different number each time they issue.. Just staple all your passports together and carry with you for travel.

Is it just me. Has anyone noticed all these new threads and posts by new members, their 1 or 2nd post and they are bashing the Indian consulting firm. They are asking for names of such firms to file a lawsuit against them. The timing of these posts is interesting with the new Senate bill S.1035, which wants to make the H1-B system unworkable by citing the example of such Indian consulting firms. One of the pretensive solution of this bill is to stop such exploitation by Indian consulting firms.

I was just getting more information on EB3 India on the net.And found an interesting blog(It makes sense to me and that why i am posting this thread)

Finally that's when you switch on your calculator and start working with the numbers. There are 140,000 visa numbers available under all the employment based categories, with 7% per country limit and 28.6% allocated for EB3 and dependents counted into the numbers, there are only about 115 EB3 primary applicants allowed from India per month. Throw in a few thousand illegals(amnesty) into the mix and now you have the royal screw-up as is happening now. The law allows visa numbers from unused countries to be transferred to the oversubscribed countries but with nearly every category retrogressed this law won't apply for a while.
The future looks toooo dark even to mention.

Some will preach how porting EB3->2 means "gaming" the system.
All very experienced EB workers who think they can get the best of everything at the price of nothing. Who want everything "risk free".

Yes and until we know what we are lobbying for, why would we part with money? What is giving money to IV going to do for us in the future? Like they say for stocks. Past performance does not guarantee future results.

Microsoft spent millions to get H1B increase. It did not happen till now. So should they stop investing in lobbying?

Why do I get a feeling you are incapable of digesting the concept of "Law of the land". There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law�s , and that too very slightly. In current situation even if you are wise and quick enough to decide to act quickly for green card, you can not do any thing except sending papers to USCIS ( INS) and paying their fee and wait endless till you get frustrated and depressed. If you are waiting for your green card you already know it. If you have not you will know it soon. Green card is almost invisible for Highly skilled immigrants from India, China, Philippines and several other countries residents, because of backlogs, country quotas, FBI name check delays, Labor Certification delays and backlogs etc. (Some of these words may be new to you. )

and that is only open category. This excellent group of people comprising of many bright people from India, China and many other countries around world, is very active in Washington D.C to change the above situation in our favor. Though it was formed in 2006 only it has around 10,000 members. All of them are fighting for our green card.

They have already established strong political contacts and are using lobbyist to pursuer changes in laws in our favor. Again, post your field of work. I somehow see reluctance here on the part of posters. 2 to 3 have done so, but the rest have not. If it is only IT for the major part, we have to analyse and see why IT is being targeted for audits... ?

I think all the fields are getting targeted. I am not from IT. As per my attorney, current situation is that PERMS for EB2's are getting 100% audited.

after filing for I-485 on Jun 1. Also filing for EAD for self and 3 family members. EB3 Nov 2001. H1B stamped in visa valid till Oct 2008.
Do I need to wait for Receipt of Filing?

YES, I am. Exactly same situation and did a lot of research. There is a good new for you man.
As far as I know, you can file for AOS and leave. Make sure when your application get's to USCIS you are here in US, after that you are free to go. You do not need to wait for the reciept. It takes weeks to get the reciept. When you come back you enter US using your valid H1-B/H4 and it does not effect your AOS application.

I have received approval on April 04 and today I have received GCs for all my family but not for one of my daughters. I checked USCIS and I just realized her application is still pending. She just turned 14 on March and she only did FP 2. Do you think she has to do again FP or they just left her behind......
Same story here. They will send RFE for biometrics for her. Expect it within a month, if you do not get it in a month, take Infopass/call and ask for biometrics appointment. My daughter's I-485 was approved next day after FP.
