IMHO you misinterpreted the memo. An employer can definitely choose not to hire based on immigration status. This has happened in the past (circa 2001) and evidently many employers do not hire H1B or any employees that require "job related" sponsorship. From the same link, in the next para it says that employers can clearly specify that they will NOT do sponsorship without violating the law. The only question is what is considered a sponsorship, any restricted position (in terms of job responsibility) can constitute a sponsorship (where by employers have legal burden beyond what it takes to hire a US Citizien/Permanent Resident for the same position). H1B definitely falls into this category and EAD borders that category. I am not an expert in labor laws but my experience says that employers have too much control on who they want to hire they can get by with almost anything. The biggest hurdle against any law suit is, EAD is an obscure document with very little clarity about rights that come with it and its usage. It was supposed to be an interim document whose usage only now is becoming main stream. May be one law suit or precedent will clarify it all. But once again employers will get by it the same way they get by with age, ethic, gender and racial descrimination.

As I had mentioned earlier in this thread - I had received 3 referral credits through IV. (actually I had sent out more invitations - but not everybody accepted/used my invitations).
For this, as I had promised earlier in this thread - I will contribute $75 to IV once I start using these referral credits (which will happen from next month once my own sign up referral bonus runs out).
Two of the three referrals who used my invitation also promised they will contribute $25 to IV for the referral.
To me, this appears to be an acceptable use of the IV message board. Anybody benefitting from IV by getting referrals may want to do the same.
OTOH, I think it is unfair to abuse the IV platform for personal gain. No other respectable message board allows that. Try these referral spam or other trolling activities in fatwallet of SD, and see how fast you get banned for it even though they are explicitly for deal hunting. Online anonymity is a great thing since it masks a trolls true identity. But think again - your identity is not really as secure behind online anonymity as you think unless you are a professional troll and have taken elaborate measures to obfuscate things. Trolling may come back to bite you.
Now, a question for mods - I went in to sign up for another recurring contribution for 3 months for $25 today (in addition to my normal subscription). However, I cant find any option for $25 recurring contribution now.

2. Has my case been picked up by an IO or is it still waiting in the holding area? If it has been picked up by an IO, nothing you can do except filling out 7001 form. If it has not been picked up by an IO, ask on the phone if an email can be sent to him advising that your case is current and waiting.
So, broadly, your goal should be to get your app moving from state 1 to state 3. Once an app lands on IO desk, it will take between 10-30 days to get it approved.

Hope this puts the debate to rest.

Hi Ron,
My Priority date is Jan 2004, EB3-India category and i have an approved I-140 and have applied my 485 during July 07. I have sent my EAD and AP for renewal which expire in last week of September. My spouse is in EB2-India having pd Dec 2005, also applied I-485 (140 is approved) during July 07 and has applied for EAD and AP renewal, which expire in last week of October. We both applied independently and are using our H1bs and not EAds.
Since my spouse's PD is going to be current in August 2008, I was planning on applying for a second 485 as a dependent on my spouse's application.
I know that two 485 applications causes issues. I want your recommendation and also will my application affect my wife's processing time or create issues for her.

You don't need to file a new I-485. Make the CIS aware of your spouse's case and your eligibility under it as a dependent. Ask them to cross reference to the two cases.

Senator's office had a very nice system of faxing in your request, just for USCIS issues, so I did that, and got a letter in three days stating that Senator has contacted USCIS for me. Later, I got another letter which included USCIS response. If there is a number for your Senator's office, I suggest pick up the phone and get talking to them.
b. I will get started immediately instead of waiting. You do not know if your IO is working on other EB-2 India applications. He could be working on a chunk of EB-4 applications and not even picking up your application from the holding area, where it can lie for many days.
c. I feel that you should submit 7001 unless you believe you know where your application is. Meaning, if multiple IOs / infopass tell you the same info, then it is probably true and you can wait. If you get nebulous answers like "wait 60 days", then submit 7001. I dont think there is any reason / advantage of an attorney submitting it. I filled it out and FedEx'ed it overnight to Washington DC.
Someone else asked me for the POJ method for TSC. I just followed the POJ instructions listed on this forum.

My colleagues and friends are sending e-mails to Judiciary committee members. I am preparing draft for this mail. I am going to divide this mail into sections. One section describing what H.R. 5882 is (recapture, justice against discriminatory treatment based on country of birth, USCIS efficiency) and another sections would describe what it is not (not amnesty, not an increase in numbers). I want a link to the testimony given by USCIS director in congress confirming the wastage of green cards. Can someone quickly direct me to that link?

I will be putting some simple messages to support 5882 to consider immiedate recapture of visas. Also clearly asking to support EB2 AND EB3 INdia. And that we are unable to buy houses cos of this limbo.
In your messages, please suggest atleast one reason how we help the country, apart from our regular x,y,z qualifications. I will be saying It helps fixing housing crisis.

I personally do not travel through a country that are biased and requires a transit visa for specific countries only. If you think about it, most of the international flights are full of us, Indians. If everybody (including Indians with GCs, that do not require a transit visa) start boycotting such airlines/country transits, then they will have to change this policy.
As I said before, I am never going to fly thru UK, even though I sill have a transit visa valid till Nov 2008. I can still feel the pain.

Even i own a house and i don't live there because of my job situation. I have rented out my house. I live 700 miles away from my own house. My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.
Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.
I support your view. Let this punjabi guy go into foreclosure and screw up his credit history and suffer for the next 7 to 14 years. Its not just him, his entire family will suffer because of this.
Those who oppose the foreclosure, i think you guys are indirectly helping this punjabi guy. He has good job, good salary and he is capable of paying his monthly mortgage and he and his family are sleeping without any issue right now. If he is not going into foreclosure then how do you think this guy will suffer for the next 7 to 14 years?
Let his choose what he wants.
Punjabi guy, you are a greedy person and you have crook'ed mind. You know you are capable of paying off your monthly mortgage and still you want to foreclose your house? Don't you have ethics, moral values? Don't you think you are trying to cheat the system?
I know foreclosure is not bad and its not against law. But who should seek foreclosure? Is it not for people who are really really in deep trouble?
Even i own a house and i don't live there because of my job situation. I have rented out my house. I live 700 miles away from my own house. My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.
Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.

I had my visa interview in Mumbai on Dec 28th. A PIMS Verfication was required for them to be able to issue me a visa. This is for an H1-B extension of stay - My six years expired in Nov. 2007 and my green card is in process.
I was told the time they are taking for procesing is 48 hours but I still have not received any notification to take my papers to the VFS center.
Has anyone in this situation already received their visa and stamped passport and if so how long did it take?

On the other day Congressman Tom Tancredo was in Lou Dobbs program and they as usual ranted about H1-B visas. I almost fell from the chair when Tom T said H1B visa is valid for 5 years and there are around 700,000 people overstaying their visas. He clearly implied the thousands of people from all over the world staying here legally as illegals.

Since Lou Dobbs didn't challenge Tom I'm sure he agrees with him. I wish somone create a video explaining how H1 can be extended beyond six years, interview some USCIS ( even ex employee), immigration lawyers and put a fitting response to this video in Youtube itself.
The Rep Tom Tancredo a vociferous anti-immigrant both legal and illegal. The very fact that Lou Dobbs allowed his show as a mouthpiece to propagate incorrect information "about H1-Bs being illegal" is worthy of a lawsuit.
How about a petition to the CEO of Time Warner asking Lou to apologize ?
