Of course, person on L1 status can work at client site as long as he/she is directly managed by company that has sponsored L1 visa. They can not be directly managed by client. That is the restriction. Have you even read posts in this thread?

I am EB2-I with a couple of US grad degrees (and same undergrad school as Rolling Flood, not that it matters to anyone except perhaps those who suppor the lawsuit). And I think this lawsuit is a bad idea because it is divisive and petty.
There is an old Malayalam story that most people who went to school in Kerala would have read in their primary school classes. Two guys, Greedy and Jealous, pray to God. God appears and Greedy goes, "I just want double of what you give the other guy. All I want to be is to be ahead of him." Hearing this, Jealous says, "God, please make me blind in one eye."
This lawsuit, like the story above, is a case of knifing others in the back, for no real gain. We should instead try to leverage IV's large membership for a common good, which is what has made IV successful so far.

I have not seen the language of the bill. Has anyone seen the exact language of the bill?
Should this bill become law (in its present form without any changes ) will the new provisions apply to ANY H1B application (i.e new applications, Transfer due to change of employer , H1B extension application with current employer) or just to NEW H1B applications and not to H1B extensions filed by the currentemployer.
There are hundreds of H1B applicants who do not have EAD but have approved PERM or approved PERM + approved I-140 and will be filing for extensions.
The H1B resttrictions in the TARP law only apply to new H1B filings.

I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.
We can definitely question them on how their understanding changed on visa spill over distribution.

Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If the post is true and from real world person, then the OP and his sponsor are in violation of the Law. The L1B are not supposed to be based/hosted in client location unless specifically stated in the approved petition. Defiantly not supposed to do in case of blanket L1B.

Why should USCIS follow the approach of oldest priority first? without any regards to the EB categories?
EB categories were created for a reason, doesn't matter how smart you are. If you are in lower skill category your wait is bound to be more. I don't see anything wrong in that.
If EB1 is current and EB2 takes 4-5 years you can't just start crying. Similarly if EB2 takes 2 years and Eb3 takes 7-8 years you can't panic. Stop being a cry baby and start respecting the inter EB level priority.

Two things about VONAGE:
1. Tax kills the deal. For me its coming more than $31 per month.
2. I searched on google about calls review. Many people are complaining that the call quality is not that good. On peak times, they do face issues.
Still calling unlimited india is a very tempting idea.;)

I personally haven't seen any issues with Call quality. Infact Call quality is excellent.

I know most of the ppl file EAD and AP along with I-485, but is it possible to file EAD and AP at a later time and not with I-485.
I know it's a stupid idea but just curious whether we can do that or not?
Also is the filing of EAD and AP also ties with your PD being current ?

Agreed that L1 dumping to replace a worker is violation in many cases and should be reported. If enough people complain, that might force companies to mend their illegal ways.

Totally agree with you! This would be a fair deal. That how it should be done so let us do that. So when are going to implement this fair deal?
I think it would be fair to split the leftover numbers the same way they split whole year quota.

Ganguteli, why do you keep on questioning everybody's intentions all the time. the other day, I had posted about L1 exploiting the loop to file GC in EB1 and your answer was plainly stupid and irritating - "I would have done the same thing if I had a chance"....
There is nothing wrong in exposing any kind of visa fraud...I came here on F1 10 years back and still in line for GC after getting masters from a decent school and working with major employers. What is wrong in making sure that it is FIFO....
It is not just Gantuteli doing this. Almost every other poster on this board seems to be doing the same. Any opinion expressed against the visa fraud perpetrated by these outsourcing cos is met with derision, ridicule and contempt. Of course, the poster is immediately labelled as an anti immigrant or a tunnel rat.
Why do the posters have to resort to ad hominem arguments ? Why dont posters consider the merits/demerits of an argument and then provide civil responses ? In my opinion even if anti immigration activitists, barring the racists, post arguments or views, those views need to be considered on due merits. Many people across a borad spectrum, including current H1B holders, GC and naturalized citizens, believe that these outsourcing cos are abusing the L1 visa and are contributing to the unemployment of high skilled labor. Is it anti immigration to raise our voices against such corrupt practices that impact our standard of living ?

I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-
1: The review was complete
2: Visa numbers were requested 2 months ago and all security/prints are current
3: Files have been forwarded to officers for completion.
In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.
As others have mentioned IV has played a big part throughout this journey. Thank you again.

My status was changed from Initial Review to PDA.The status changed on Aug 7th. There is no CPO or Decision status in between.
I see the following message
On August 6, 2010, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
I got my 485 Approval notice copy on Dec 13th and haven't received any welcome letter or my actual card.
Is any one in the same state. How long does it take for the actual card to come.
I need to renew my DL by end of this month. Can I renew it using my 485 Approval notice copy?

It is WAC and was approved in Mar 2007. My earlier two H1 petitions were from EAC. I have two H1 transfers in my H1 history.
I guess the cases with transfer and extensions are getting delayed.
