I am actually very dissappointed with myself. In the post rally MC fluster, I had made a mental note to introduce Logiclife and then give him a flower. But I hear he strongly opposes measures such as this :)

Thank you for your effort. Recapture of unused visas will eliminate most of the backlogs (does it require a congressional approval or if anything can be done as a part of an admin fix). Anything that requires a congressional will be lumped with the CIR, we are a small group of people held hostage at the mercy of CIR.

After a long wait i have my priority date became current. But my employer is saying to wait for some more time before he can file for I485.What can i do in this scenario? He is saying the dates are going to remian the same for next couple of months.Please suggest.

Name the company. It is very important. You have worked patiently for so many years for your GC and now this! It is criminal behavior on your company's part to delay the process any longer. Such unscrupulous people must be exposed immediately.

GC is a future job offer - and at the time of adjucation of 485, u must have a valid job offer. till that date u can stay in the US even without working for any employer but at the time of adjucation u must be employed in a similar position.

This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.
Please with experience/knowledge, please share your information.

It seems some people already coverted\or in the process of coverting from Eb3 to Eb2. Even I did that recently.

This process was already done by many in later part of 2005, entire 2006 and in early part of 2007. We do not know how many got out from the 485 Que in 2007. Many of those might have filed 485 recently in the july fiasco. The impact of these conversion will be felt only after 5 to 6 months or even after an year.

Read the approval letter. It states that you would need to travel outside the US and apply for H1 visa at US Consulate abroad. If your visa is granted then you can re-enter US with new I-94 card. Stay inside US without a valid I-94 is considered Out-Of-Status.

My husband got his Card Production Ordered email yest night...
His PD :2004 Jun
RD : Aug 15th 2007
ND Oct 15th 2007.
He is extremely happy and over the moon after a long wait.... My case was added in later 2008 Aug RD as a dependent and my status hasn't changed yet. I don't know if it is important that I get mine ASAP as well... Will I be getting it soon, as well? Any thoughts. Do I need to follow up?
Congrats to all those who received the GCs... And good luck to all in the queue ...
